口頭約定入職后試用期為1個月是否有效?

用人單位與員工口(kou)頭約定入職(zhi)后試用期(qi)為1個月,但未簽定書面勞動合同,請問是否(fou)有效?

《勞動合(he)同(tong)(tong)法》規(gui)定(ding):試(shi)(shi)用期(qi)(qi)包含(han)在勞動合(he)同(tong)(tong)期(qi)(qi)限內。因此沒有(you)簽(qian)定(ding)書面(mian)勞動合(he)同(tong)(tong)的,雙方口(kou)頭約定(ding)的試(shi)(shi)用期(qi)(qi)無效,視為(wei)雙方未約定(ding)試(shi)(shi)用期(qi)(qi)。
