公司在哪些情況下解除合同需要支付違約金啊?

答 《勞(lao)(lao)動(dong)合(he)同(tong)(tong)法》第40條規定(ding):在以下三(san)種(zhong)情形(xing)下,用人單(dan)位(wei)(wei)向勞(lao)(lao)動(dong)者(zhe)提出解除勞(lao)(lao)動(dong)合(he)同(tong)(tong)時(shi),應(ying)支付經(jing)濟補償金:(1)勞(lao)(lao)動(dong)者(zhe)患病或者(zhe)非因(yin)工(gong)負傷,在規定(ding)的醫(yi)療期(qi)滿后不能從事原工(gong)作,也不能從事由用人單(dan)位(wei)(wei)另行安(an)排的工(gong)作的;(2)勞(lao)(lao)動(dong)者(zhe)不能勝(sheng)任(ren)工(gong)作,經(jing)過培(pei)訓或者(zhe)調(diao)整(zheng)工(gong)作崗位(wei)(wei),仍(reng)不能勝(sheng)任(ren)工(gong)作的;(3)勞(lao)(lao)動(dong)合(he)同(tong)(tong)訂立時(shi)所依據(ju)的客(ke)觀(guan)情況發生重(zhong)大變(bian)化,致(zhi)使勞(lao)(lao)動(dong)合(he)同(tong)(tong)無法履行,經(jing)用人單(dan)位(wei)(wei)與(yu)勞(lao)(lao)動(dong)者(zhe)協商,未能就變(bian)更(geng)勞(lao)(lao)動(dong)合(he)同(tong)(tong)內容達成協議的。
