上班一個月后簽合同違法么?

單(dan)(dan)位(wei)(wei)在(zai)建立(li)(li)(li)勞動(dong)(dong)(dong)關(guan)系之日(ri)起(qi)最遲應在(zai)“一(yi)個(ge)(ge)(ge)月”內(nei)訂(ding)(ding)立(li)(li)(li)書面(mian)勞動(dong)(dong)(dong)合(he)同(tong)(tong)。因此(ci),這實際上(shang)是有限度地放寬(kuan)了訂(ding)(ding)立(li)(li)(li)勞動(dong)(dong)(dong)合(he)同(tong)(tong)的(de)(de)時間(jian)要求,規定已(yi)建立(li)(li)(li)勞動(dong)(dong)(dong)關(guan)系,未(wei)(wei)同(tong)(tong)時訂(ding)(ding)立(li)(li)(li)書面(mian)勞動(dong)(dong)(dong)合(he)同(tong)(tong)的(de)(de),如(ru)(ru)果(guo)在(zai)自用(yong)(yong)工之日(ri)起(qi)一(yi)個(ge)(ge)(ge)月內(nei)訂(ding)(ding)立(li)(li)(li)了書面(mian)勞動(dong)(dong)(dong)合(he)同(tong)(tong),其行為即(ji)不違法。但如(ru)(ru)果(guo)用(yong)(yong)人單(dan)(dan)位(wei)(wei)自用(yong)(yong)工之日(ri)起(qi)超過一(yi)個(ge)(ge)(ge)月不滿一(yi)年(nian)未(wei)(wei)與(yu)勞動(dong)(dong)(dong)者訂(ding)(ding)立(li)(li)(li)書面(mian)勞動(dong)(dong)(dong)合(he)同(tong)(tong)的(de)(de),則(ze)應當(dang)向勞動(dong)(dong)(dong)者每月支(zhi)付兩倍的(de)(de)工資(《勞動(dong)(dong)(dong)合(he)同(tong)(tong)法》第82條)。這是對用(yong)(yong)人單(dan)(dan)位(wei)(wei)在(zai)自用(yong)(yong)工之日(ri)一(yi)個(ge)(ge)(ge)月內(nei)未(wei)(wei)訂(ding)(ding)立(li)(li)(li)書面(mian)勞動(dong)(dong)(dong)合(he)同(tong)(tong)的(de)(de)處罰(fa)措施。
