上班一個月后簽合同違法么?

答 單位(wei)在建立勞(lao)(lao)(lao)動(dong)(dong)關(guan)系(xi)之(zhi)日起最遲應在“一(yi)個(ge)(ge)月(yue)(yue)”內訂(ding)立書面(mian)(mian)(mian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)。因此,這(zhe)(zhe)實(shi)際上是(shi)(shi)有限度地放寬了訂(ding)立勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)的時間要(yao)求,規定已(yi)建立勞(lao)(lao)(lao)動(dong)(dong)關(guan)系(xi),未同(tong)時訂(ding)立書面(mian)(mian)(mian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)的,如(ru)(ru)果在自用工(gong)之(zhi)日起一(yi)個(ge)(ge)月(yue)(yue)內訂(ding)立了書面(mian)(mian)(mian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong),其(qi)行為即不(bu)違(wei)法。但如(ru)(ru)果用人單位(wei)自用工(gong)之(zhi)日起超(chao)過(guo)一(yi)個(ge)(ge)月(yue)(yue)不(bu)滿一(yi)年未與勞(lao)(lao)(lao)動(dong)(dong)者(zhe)訂(ding)立書面(mian)(mian)(mian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)的,則應當向勞(lao)(lao)(lao)動(dong)(dong)者(zhe)每(mei)月(yue)(yue)支付(fu)兩倍的工(gong)資(zi)(《勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)法》第82條)。這(zhe)(zhe)是(shi)(shi)對(dui)用人單位(wei)在自用工(gong)之(zhi)日一(yi)個(ge)(ge)月(yue)(yue)內未訂(ding)立書面(mian)(mian)(mian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)的處罰措施。
