答 《勞(lao)動(dong)合(he)(he)同(tong)法》第(di)十(shi)九(jiu)條規定了試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)的(de)上限(xian)(xian),即(ji)勞(lao)動(dong)合(he)(he)同(tong)期(qi)(qi)(qi)(qi)限(xian)(xian)三個(ge)月以(yi)(yi)上不(bu)滿一年的(de),試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)不(bu)得(de)超過(guo)一個(ge)月;勞(lao)動(dong)合(he)(he)同(tong)期(qi)(qi)(qi)(qi)限(xian)(xian)一年以(yi)(yi)上不(bu)滿三年的(de),試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)不(bu)得(de)超過(guo)二個(ge)月;三年以(yi)(yi)上固定期(qi)(qi)(qi)(qi)限(xian)(xian)和無固定期(qi)(qi)(qi)(qi)限(xian)(xian)的(de)勞(lao)動(dong)合(he)(he)同(tong),試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)不(bu)得(de)超過(guo)六個(ge)月。 如果(guo)勞(lao)動(dong)者在試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)內(nei)達(da)不(bu)到用(yong)(yong)(yong)人單位的(de)要求(qiu),用(yong)(yong)(yong)人單位可(ke)根據勞(lao)動(dong)合(he)(he)同(tong)法第(di)三十(shi)九(jiu)條之規定以(yi)(yi)勞(lao)動(dong)者在試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)間被證明(ming)不(bu)符合(he)(he)錄用(yong)(yong)(yong)條件為由解除勞(lao)動(dong)合(he)(he)同(tong),但不(bu)得(de)延長試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)(qi),用(yong)(yong)(yong)人單位延長試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)(qi)的(de),屬于(yu)違法約定試(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)(qi),需(xu)承擔相(xiang)應的(de)法律后果(guo)。
