答 工(gong)(gong)(gong)(gong)傷保(bao)險條例(li)規定“在(zai)工(gong)(gong)(gong)(gong)作(zuo)時(shi)(shi)間和工(gong)(gong)(gong)(gong)作(zuo)崗(gang)位(wei)(wei),突發(fa)疾病死亡(wang)或者在(zai)48小時(shi)(shi)之內(nei)經搶救(jiu)無效死亡(wang)的(de),可認(ren)定為(wei)工(gong)(gong)(gong)(gong)傷”。“過勞死”就是在(zai)工(gong)(gong)(gong)(gong)作(zuo)時(shi)(shi)間和工(gong)(gong)(gong)(gong)作(zuo)崗(gang)位(wei)(wei)突發(fa)疾病死亡(wang),因此“過勞死”認(ren)定為(wei)工(gong)(gong)(gong)(gong)傷的(de)關(guan)鍵(jian)在(zai)于是否在(zai)工(gong)(gong)(gong)(gong)作(zuo)時(shi)(shi)間和工(gong)(gong)(gong)(gong)作(zuo)崗(gang)位(wei)(wei)。如果能(neng)夠證明是在(zai)工(gong)(gong)(gong)(gong)作(zuo)時(shi)(shi)間、工(gong)(gong)(gong)(gong)作(zuo)崗(gang)位(wei)(wei)上發(fa)生的(de),則應(ying)該主張為(wei)工(gong)(gong)(gong)(gong)傷。
