目前解決(jue)勞(lao)動(dong)(dong)爭(zheng)議(yi)(yi)的機構和途徑很多。勞(lao)動(dong)(dong)者(zhe)和用人(ren)(ren)單位(wei)發(fa)生(sheng)爭(zheng)議(yi)(yi)后,雙方可(ke)以(yi)協商解決(jue),自行(xing)處理(li)。勞(lao)動(dong)(dong)者(zhe)也(ye)(ye)可(ke)以(yi)向(xiang)(xiang)本單位(wei)勞(lao)動(dong)(dong)爭(zheng)議(yi)(yi)調解委員(yuan)(yuan)會申請(qing)調解。如果(guo)沒有(you)達(da)成調解協議(yi)(yi)或者(zhe)勞(lao)動(dong)(dong)者(zhe)拒絕調解而要求仲(zhong)裁(cai)的,也(ye)(ye)可(ke)以(yi)由勞(lao)動(dong)(dong)者(zhe)直接向(xiang)(xiang)勞(lao)動(dong)(dong)爭(zheng)議(yi)(yi)仲(zhong)裁(cai)委員(yuan)(yuan)會申請(qing)仲(zhong)裁(cai)。如果(guo)勞(lao)動(dong)(dong)者(zhe)對(dui)仲(zhong)裁(cai)委員(yuan)(yuan)會的裁(cai)決(jue)不服(fu),還(huan)可(ke)以(yi)向(xiang)(xiang)人(ren)(ren)民法院提(ti)起訴訟。勞(lao)動(dong)(dong)爭(zheng)議(yi)(yi)案件(jian)申請(qing)仲(zhong)裁(cai)是必須程(cheng)序(xu),人(ren)(ren)民法院只有(you)在當事人(ren)(ren)對(dui)仲(zhong)裁(cai)結果(guo)不服(fu)時(shi)才受理(li)訴訟。
