《勞動合同法》有沒有規定勞動合同的最低年限呢?

《勞(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)法(fa)(fa)》沒有(you)規定(ding)(ding)勞(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的(de)最低年限(xian),但(dan)是(shi)該法(fa)(fa)的(de)第(di)(di)(di)十(shi)四條規定(ding)(ding):“用人單位(wei)與(yu)勞(lao)(lao)(lao)(lao)(lao)動(dong)者協商(shang)一致(zhi),可以訂(ding)(ding)立(li)無固(gu)(gu)(gu)定(ding)(ding)期限(xian)勞(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)。有(you)下列情形之一,勞(lao)(lao)(lao)(lao)(lao)動(dong)者提出或者同(tong)(tong)(tong)意續(xu)訂(ding)(ding)、訂(ding)(ding)立(li)勞(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的(de),除勞(lao)(lao)(lao)(lao)(lao)動(dong)者提出訂(ding)(ding)立(li)固(gu)(gu)(gu)定(ding)(ding)期限(xian)勞(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)外,應當訂(ding)(ding)立(li)無固(gu)(gu)(gu)定(ding)(ding)期限(xian)勞(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong):……(三)連續(xu)訂(ding)(ding)立(li)二(er)次(ci)固(gu)(gu)(gu)定(ding)(ding)期限(xian)勞(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong),且勞(lao)(lao)(lao)(lao)(lao)動(dong)者沒有(you)本(ben)法(fa)(fa)第(di)(di)(di)三十(shi)九(jiu)條和第(di)(di)(di)四十(shi)條第(di)(di)(di)一項、第(di)(di)(di)二(er)項規定(ding)(ding)的(de)情形,續(xu)訂(ding)(ding)勞(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的(de)。”這樣一來,從(cong)2008年起計算,員工(gong)與(yu)同(tong)(tong)(tong)一用人單位(wei)簽(qian)過兩(liang)次(ci)固(gu)(gu)(gu)定(ding)(ding)期限(xian)合(he)同(tong)(tong)(tong)后,第(di)(di)(di)三次(ci)就(jiu)(jiu)有(you)權要求簽(qian)訂(ding)(ding)無固(gu)(gu)(gu)定(ding)(ding)期限(xian)勞(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)。前兩(liang)次(ci)固(gu)(gu)(gu)定(ding)(ding)期限(xian)越短,第(di)(di)(di)三次(ci)來得就(jiu)(jiu)越早。
