《勞動合同法》有沒有規定勞動合同的最低年限呢?

我想(xiang)這(zhe)里咨詢一(yi)下,《勞(lao)動合同法》有(you)沒有(you)規定勞(lao)動合同的最低(di)年限呢(ni)?

《勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)》沒(mei)有(you)規定(ding)(ding)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)的最低年限(xian)(xian)(xian),但(dan)是該(gai)法(fa)的第(di)十(shi)四條規定(ding)(ding):“用(yong)人單位與(yu)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者協商一致,可(ke)以訂(ding)立無(wu)(wu)固(gu)定(ding)(ding)期限(xian)(xian)(xian)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)。有(you)下列情(qing)形(xing)之一,勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者提出或者同(tong)(tong)意(yi)續(xu)訂(ding)、訂(ding)立勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)的,除勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者提出訂(ding)立固(gu)定(ding)(ding)期限(xian)(xian)(xian)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)外,應當(dang)訂(ding)立無(wu)(wu)固(gu)定(ding)(ding)期限(xian)(xian)(xian)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong):……(三)連續(xu)訂(ding)立二次(ci)固(gu)定(ding)(ding)期限(xian)(xian)(xian)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong),且勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者沒(mei)有(you)本法(fa)第(di)三十(shi)九(jiu)條和第(di)四十(shi)條第(di)一項、第(di)二項規定(ding)(ding)的情(qing)形(xing),續(xu)訂(ding)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)的。”這(zhe)樣一來,從2008年起計算(suan),員工(gong)與(yu)同(tong)(tong)一用(yong)人單位簽過兩次(ci)固(gu)定(ding)(ding)期限(xian)(xian)(xian)合(he)同(tong)(tong)后,第(di)三次(ci)就有(you)權要求簽訂(ding)無(wu)(wu)固(gu)定(ding)(ding)期限(xian)(xian)(xian)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)。前兩次(ci)固(gu)定(ding)(ding)期限(xian)(xian)(xian)越短,第(di)三次(ci)來得就越早。
