《勞動合同法》有沒有規定勞動合同的最低年限呢?

我想(xiang)這里咨詢一(yi)下,《勞動(dong)合同法(fa)》有(you)沒有(you)規定(ding)勞動(dong)合同的(de)最低年限呢?

《勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)法》沒有(you)規定(ding)(ding)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)的最低(di)年限(xian)(xian),但(dan)是該法的第(di)十(shi)四條(tiao)規定(ding)(ding):“用人單位與(yu)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)協商一(yi)致,可以(yi)訂(ding)(ding)立(li)無固(gu)定(ding)(ding)期(qi)限(xian)(xian)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)。有(you)下(xia)列(lie)情形之一(yi),勞(lao)(lao)動(dong)(dong)(dong)者(zhe)提出(chu)或(huo)者(zhe)同(tong)意續(xu)訂(ding)(ding)、訂(ding)(ding)立(li)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)的,除勞(lao)(lao)動(dong)(dong)(dong)者(zhe)提出(chu)訂(ding)(ding)立(li)固(gu)定(ding)(ding)期(qi)限(xian)(xian)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)外(wai),應當(dang)訂(ding)(ding)立(li)無固(gu)定(ding)(ding)期(qi)限(xian)(xian)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong):……(三(san))連續(xu)訂(ding)(ding)立(li)二次(ci)(ci)(ci)(ci)固(gu)定(ding)(ding)期(qi)限(xian)(xian)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong),且(qie)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)沒有(you)本法第(di)三(san)十(shi)九條(tiao)和第(di)四十(shi)條(tiao)第(di)一(yi)項、第(di)二項規定(ding)(ding)的情形,續(xu)訂(ding)(ding)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)的。”這樣一(yi)來,從2008年起(qi)計算,員工與(yu)同(tong)一(yi)用人單位簽過兩(liang)次(ci)(ci)(ci)(ci)固(gu)定(ding)(ding)期(qi)限(xian)(xian)合(he)同(tong)后,第(di)三(san)次(ci)(ci)(ci)(ci)就有(you)權要(yao)求簽訂(ding)(ding)無固(gu)定(ding)(ding)期(qi)限(xian)(xian)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)。前兩(liang)次(ci)(ci)(ci)(ci)固(gu)定(ding)(ding)期(qi)限(xian)(xian)越短(duan),第(di)三(san)次(ci)(ci)(ci)(ci)來得(de)就越早(zao)。
