根據(ju)《勞(lao)動(dong)(dong)合(he)同法(fa)(fa)》第八十三條規(gui)定(ding)(ding)(ding):“用(yong)(yong)人單位(wei)違反(fan)本法(fa)(fa)規(gui)定(ding)(ding)(ding)與勞(lao)動(dong)(dong)者約(yue)定(ding)(ding)(ding)試(shi)用(yong)(yong)期(qi)(qi)的(de),由(you)勞(lao)動(dong)(dong)行政部門(men)責令改正(zheng);違法(fa)(fa)約(yue)定(ding)(ding)(ding)的(de)試(shi)用(yong)(yong)期(qi)(qi)已經履(lv)行的(de),由(you)用(yong)(yong)人單位(wei)以勞(lao)動(dong)(dong)者試(shi)用(yong)(yong)期(qi)(qi)滿月工(gong)資為標準,按已經履(lv)行的(de)超過法(fa)(fa)定(ding)(ding)(ding)試(shi)用(yong)(yong)期(qi)(qi)的(de)期(qi)(qi)間向勞(lao)動(dong)(dong)者支(zhi)付賠償金。”
