問 近期(qi)(qi)我(wo)們招(zhao)聘了(le)一(yi)個因生寶寶離開公(gong)司的員工,請問(wen)二次入職是(shi)否(fou)還(huan)能設定(ding)試用期(qi)(qi)?
答 勞動合同(tong)法已(yi)經規定很清楚,同(tong)一(yi)用(yong)(yong)人(ren)單(dan)位(wei)對同(tong)一(yi)個勞動者只(zhi)能(neng)約定一(yi)次試用(yong)(yong)期(qi),并沒有加前置條件,也(ye)就是(shi)不(bu)管是(shi)續簽、還(huan)是(shi)離職后又入(ru)職重新簽,只(zhi)要是(shi)同(tong)一(yi)個人(ren),同(tong)一(yi)用(yong)(yong)人(ren)單(dan)位(wei)在法律角度上就不(bu)能(neng)約定“第二次”
