勞動(dong)者(zhe)在工作時,一般都會遇到有關試(shi)(shi)用期問題。那么,勞動(dong)者(zhe)在剛(gang)入職后,要怎么才能確定試(shi)(shi)用期呢?

根據(ju)《勞(lao)(lao)動(dong)(dong)合同(tong)法》第(di)十九條的規定,試用(yong)期的上限(xian)根據(ju)勞(lao)(lao)動(dong)(dong)合同(tong)期限(xian)設(she)定:勞(lao)(lao)動(dong)(dong)合同(tong)期限(xian)3個(ge)月(yue)以(yi)上不(bu)(bu)滿3年(nian)的,試用(yong)期不(bu)(bu)得(de)超過1個(ge)月(yue);勞(lao)(lao)動(dong)(dong)合同(tong)期限(xian)1年(nian)以(yi)上不(bu)(bu)滿3年(nian)的,試用(yong)期不(bu)(bu)得(de)超過2個(ge)月(yue);3年(nian)以(yi)上固(gu)定期限(xian)和無(wu)固(gu)定期限(xian)的勞(lao)(lao)動(dong)(dong)合同(tong),試用(yong)期不(bu)(bu)得(de)超過6個(ge)月(yue)。
