答 《勞(lao)動(dong)合同(tong)法》規定,用(yong)(yong)人(ren)(ren)單位自用(yong)(yong)工(gong)(gong)之(zhi)日(ri)起超(chao)過(guo)一(yi)個月不(bu)滿(man)一(yi)年未與(yu)勞(lao)動(dong)者訂立(li)(li)書(shu)面(mian)勞(lao)動(dong)合同(tong)的,應當(dang)向勞(lao)動(dong)者每月支付(fu)二倍的工(gong)(gong)資。用(yong)(yong)人(ren)(ren)單位違(wei)反本法規定不(bu)與(yu)勞(lao)動(dong)者訂立(li)(li)無固(gu)定期限(xian)勞(lao)動(dong)合同(tong)的,自應當(dang)訂立(li)(li)無固(gu)定期限(xian)勞(lao)動(dong)合同(tong)之(zhi)日(ri)起向勞(lao)動(dong)者每月支付(fu)二倍的工(gong)(gong)資,用(yong)(yong)工(gong)(gong)之(zhi)日(ri)包含了試用(yong)(yong)期。
