《勞(lao)(lao)動(dong)合(he)同法(fa)》規(gui)定,用(yong)(yong)(yong)人單位(wei)自用(yong)(yong)(yong)工之日(ri)起超過一個月(yue)不滿一年未(wei)與勞(lao)(lao)動(dong)者(zhe)訂立(li)書面勞(lao)(lao)動(dong)合(he)同的(de),應當向勞(lao)(lao)動(dong)者(zhe)每月(yue)支(zhi)付二倍的(de)工資。用(yong)(yong)(yong)人單位(wei)違(wei)反本法(fa)規(gui)定不與勞(lao)(lao)動(dong)者(zhe)訂立(li)無固定期(qi)(qi)限(xian)勞(lao)(lao)動(dong)合(he)同的(de),自應當訂立(li)無固定期(qi)(qi)限(xian)勞(lao)(lao)動(dong)合(he)同之日(ri)起向勞(lao)(lao)動(dong)者(zhe)每月(yue)支(zhi)付二倍的(de)工資,用(yong)(yong)(yong)工之日(ri)包含了試用(yong)(yong)(yong)期(qi)(qi)。
