試用期工資可以隨意約定嗎?

我(wo)(wo)們現在的單位以試(shi)用(yong)期為(wei)借口(kou),不給(gei)我(wo)(wo)們繳(jiao)納(na)社會保險金,還隨意壓(ya)低試(shi)用(yong)期工資(zi)。這樣做合法嗎?

答(da) 這些做法(fa)是(shi)違法(fa)的。《勞(lao)(lao)動(dong)合(he)同法(fa)實(shi)施(shi)條例》第(di)十(shi)五條規定(ding),勞(lao)(lao)動(dong)者在(zai)試用(yong)(yong)期的工(gong)資不(bu)得(de)(de)低于本單位(wei)相同崗(gang)位(wei)最低檔工(gong)資的80%或者不(bu)得(de)(de)低于勞(lao)(lao)動(dong)合(he)同約定(ding)工(gong)資的80%,并不(bu)得(de)(de)低于用(yong)(yong)人單位(wei)所在(zai)地(di)的最低工(gong)資標準(zhun)。試用(yong)(yong)期包含在(zai)勞(lao)(lao)動(dong)合(he)同期限(xian)內。在(zai)勞(lao)(lao)動(dong)合(he)同期限(xian)內,單位(wei)為職工(gong)繳納社(she)(she)會保(bao)險(xian)(xian)是(shi)法(fa)定(ding)義務。因此單位(wei)不(bu)能以試用(yong)(yong)期為借口不(bu)繳社(she)(she)會保(bao)險(xian)(xian)金。
