試用期工資可以隨意約定嗎?
問 我們現在的單位以(yi)試(shi)用期(qi)(qi)為借口,不給(gei)我們繳納社(she)會保(bao)險金(jin),還隨意壓低試(shi)用期(qi)(qi)工(gong)資。這樣做合法嗎?
答 這些做法是(shi)違法的(de)。《勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)法實施條例》第十五條規定,勞動(dong)(dong)(dong)者(zhe)在試用期的(de)工(gong)資(zi)不得低于本單(dan)位(wei)相同(tong)(tong)(tong)崗位(wei)最(zui)低檔工(gong)資(zi)的(de)80%或(huo)者(zhe)不得低于勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)約定工(gong)資(zi)的(de)80%,并(bing)不得低于用人單(dan)位(wei)所在地(di)的(de)最(zui)低工(gong)資(zi)標準。試用期包含在勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)期限內。在勞動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)期限內,單(dan)位(wei)為職工(gong)繳(jiao)納(na)社(she)會(hui)保(bao)險(xian)是(shi)法定義務(wu)。因(yin)此單(dan)位(wei)不能以(yi)試用期為借口不繳(jiao)社(she)會(hui)保(bao)險(xian)金(jin)。
