試用期工資可以隨意約定嗎?

我們(men)現在的單位以(yi)試用期為借口,不給我們(men)繳納社會保險金,還(huan)隨意壓(ya)低試用期工資。這樣做(zuo)合法嗎(ma)?

這(zhe)些做法是(shi)違法的。《勞動(dong)(dong)合同(tong)法實施條(tiao)例》第十五條(tiao)規(gui)定(ding),勞動(dong)(dong)者在(zai)試用期(qi)的工(gong)資(zi)不(bu)(bu)得(de)低(di)于(yu)本單位(wei)相同(tong)崗位(wei)最低(di)檔工(gong)資(zi)的80%或者不(bu)(bu)得(de)低(di)于(yu)勞動(dong)(dong)合同(tong)約定(ding)工(gong)資(zi)的80%,并不(bu)(bu)得(de)低(di)于(yu)用人(ren)單位(wei)所在(zai)地的最低(di)工(gong)資(zi)標準。試用期(qi)包(bao)含(han)在(zai)勞動(dong)(dong)合同(tong)期(qi)限內。在(zai)勞動(dong)(dong)合同(tong)期(qi)限內,單位(wei)為職工(gong)繳(jiao)納社會保險是(shi)法定(ding)義務(wu)。因此單位(wei)不(bu)(bu)能以試用期(qi)為借口不(bu)(bu)繳(jiao)社會保險金。
