答 用(yong)(yong)(yong)人單(dan)位(wei)(wei)未與勞(lao)(lao)動(dong)(dong)者(zhe)簽訂勞(lao)(lao)動(dong)(dong)合同,認定勞(lao)(lao)動(dong)(dong)關系時(shi)可參(can)照(zhao)下列憑(ping)證(zheng): 1)工(gong)資(zi)(zi)支(zhi)付(fu)憑(ping)證(zheng)或記(ji)錄(lu)(lu)(職工(gong)工(gong)資(zi)(zi)發放(fang)花名冊(ce))、繳納各項社會(hui)保險費的記(ji)錄(lu)(lu); 2)用(yong)(yong)(yong)人單(dan)位(wei)(wei)向勞(lao)(lao)動(dong)(dong)者(zhe)發放(fang)的“工(gong)作證(zheng)”、“服(fu)務證(zheng)”等(deng)(deng)能夠(gou)證(zheng)明身(shen)份的證(zheng)件; 3)勞(lao)(lao)動(dong)(dong)者(zhe)填寫的用(yong)(yong)(yong)人單(dan)位(wei)(wei)招(zhao)工(gong)招(zhao)聘“登記(ji)表”、“報名表”等(deng)(deng)招(zhao)用(yong)(yong)(yong)記(ji)錄(lu)(lu); 4)考勤(qin)記(ji)錄(lu)(lu); 5)其他(ta)勞(lao)(lao)動(dong)(dong)者(zhe)的證(zheng)人證(zheng)言等(deng)(deng)。 6)其中,1)、3)、4)項的有關憑(ping)證(zheng)由用(yong)(yong)(yong)人單(dan)位(wei)(wei)負責舉(ju)證(zheng)責任。
