答 根(gen)據(ju)我國勞(lao)(lao)(lao)動(dong)(dong)(dong)法的規定,勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)可(ke)采取以(yi)下三(san)種方式(shi)(shi)解除(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong): 第(di)(di)一,與(yu)用(yong)人單(dan)位(wei)協商一致解除(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)。采用(yong)這種方式(shi)(shi)解除(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong),只要勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)與(yu)用(yong)人單(dan)位(wei)就(jiu)解除(chu)(chu)合(he)同(tong)(tong)(tong)(tong)的有(you)關事(shi)項(xiang)協商一致,就(jiu)可(ke)以(yi)解除(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong),辦理離職手(shou)續(xu)。 第(di)(di)二(er),提(ti)前30日以(yi)書面形式(shi)(shi)通(tong)知用(yong)人單(dan)位(wei)解除(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)。 第(di)(di)三(san),有(you)下列情形之一的,勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)可(ke)隨時通(tong)知用(yong)人單(dan)位(wei)解除(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong): (1) 在(zai)試用(yong)期內的; (2) 用(yong)人單(dan)位(wei)以(yi)暴(bao)力、威(wei)脅或非(fei)法限制(zhi)人身自由的手(shou)段強迫勞(lao)(lao)(lao)動(dong)(dong)(dong)的; (3) 用(yong)人單(dan)位(wei)未按照勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)約定支付勞(lao)(lao)(lao)動(dong)(dong)(dong)報酬或提(ti)供勞(lao)(lao)(lao)動(dong)(dong)(dong)條件的。
