根據(ju)我國(guo)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)法(fa)的(de)(de)規定(ding),勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者可(ke)采(cai)(cai)取以(yi)下三(san)(san)種(zhong)(zhong)方式解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong): 第(di)一,與(yu)用(yong)(yong)人(ren)單位(wei)協商一致解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)。采(cai)(cai)用(yong)(yong)這種(zhong)(zhong)方式解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong),只要(yao)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者與(yu)用(yong)(yong)人(ren)單位(wei)就解(jie)除(chu)合同(tong)(tong)的(de)(de)有關事項協商一致,就可(ke)以(yi)解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong),辦理離職(zhi)手續。 第(di)二,提前(qian)30日以(yi)書面形式通知用(yong)(yong)人(ren)單位(wei)解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)。 第(di)三(san)(san),有下列情形之一的(de)(de),勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者可(ke)隨時通知用(yong)(yong)人(ren)單位(wei)解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong): (1) 在試用(yong)(yong)期內的(de)(de); (2) 用(yong)(yong)人(ren)單位(wei)以(yi)暴力、威脅或非(fei)法(fa)限制人(ren)身自由的(de)(de)手段強迫勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)的(de)(de); (3) 用(yong)(yong)人(ren)單位(wei)未按照勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)約定(ding)支付勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)報酬或提供勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)條件的(de)(de)。
