答(da) 《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)法(fa)實施條(tiao)(tiao)例》第十八條(tiao)(tiao)　有下列(lie)情形(xing)(xing)之一(yi)的(de)(de)(de)，依(yi)照(zhao)(zhao)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)法(fa)規(gui)(gui)定(ding)(ding)的(de)(de)(de)條(tiao)(tiao)件(jian)、程序，勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)可以(yi)與用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)解除(chu)(chu)固定(ding)(ding)期(qi)(qi)限勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)、無固定(ding)(ding)期(qi)(qi)限勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)或者(zhe)(zhe)(zhe)(zhe)以(yi)完(wan)成(cheng)一(yi)定(ding)(ding)工作任務為期(qi)(qi)限的(de)(de)(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)： （一(yi)）勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)與用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)協商一(yi)致的(de)(de)(de)； （二）勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)提(ti)(ti)前30日(ri)以(yi)書面形(xing)(xing)式通知用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)的(de)(de)(de)； （三(san)）勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)在試用(yong)(yong)(yong)期(qi)(qi)內提(ti)(ti)前3日(ri)通知用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)的(de)(de)(de)； （四）用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)未按照(zhao)(zhao)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)約定(ding)(ding)提(ti)(ti)供勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)保(bao)護或者(zhe)(zhe)(zhe)(zhe)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)條(tiao)(tiao)件(jian)的(de)(de)(de)； （五）用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)未及時(shi)足(zu)額支付勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)報(bao)酬的(de)(de)(de)； （六）用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)未依(yi)法(fa)為勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)繳(jiao)納社會保(bao)險費(fei)的(de)(de)(de)； （七）用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)的(de)(de)(de)規(gui)(gui)章制(zhi)度違反法(fa)律、法(fa)規(gui)(gui)的(de)(de)(de)規(gui)(gui)定(ding)(ding)，損(sun)害(hai)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)權(quan)益的(de)(de)(de)； （八）用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)以(yi)欺詐、脅迫的(de)(de)(de)手段(duan)或者(zhe)(zhe)(zhe)(zhe)乘人(ren)(ren)(ren)(ren)(ren)之危，使勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)在違背真(zhen)實意思的(de)(de)(de)情況下訂(ding)立(li)或者(zhe)(zhe)(zhe)(zhe)變更勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)的(de)(de)(de)； （九）用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)在勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)中(zhong)免除(chu)(chu)自己的(de)(de)(de)法(fa)定(ding)(ding)責任、排(pai)除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)權(quan)利的(de)(de)(de)； （十）用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)違反法(fa)律、行(xing)政(zheng)法(fa)規(gui)(gui)強制(zhi)性規(gui)(gui)定(ding)(ding)的(de)(de)(de)； （十一(yi)）用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)以(yi)暴(bao)力、威脅或者(zhe)(zhe)(zhe)(zhe)非(fei)法(fa)限制(zhi)人(ren)(ren)(ren)(ren)(ren)身(shen)自由(you)的(de)(de)(de)手段(duan)強迫勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)的(de)(de)(de)； （十二）用(yong)(yong)(yong)人(ren)(ren)(ren)(ren)(ren)單(dan)(dan)位(wei)(wei)違章指揮(hui)、強令冒(mao)險作業危及勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)人(ren)(ren)(ren)(ren)(ren)身(shen)安(an)全的(de)(de)(de)； （十三(san)）法(fa)律、行(xing)政(zheng)法(fa)規(gui)(gui)規(gui)(gui)定(ding)(ding)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)可以(yi)解除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)的(de)(de)(de)其他情形(xing)(xing)。
