《勞動合同法》有沒有規定勞動者的辭職自主權?

我年前找了(le)一(yi)份新(xin)工作,感覺自(zi)己不適合,想辭職(zhi),勞動者有辭職(zhi)自(zi)主權嗎?

《勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)法(fa)》第37條規(gui)(gui)定(ding):勞(lao)(lao)動(dong)(dong)(dong)者(zhe)提前30日以書(shu)面形式通知用人單位,可以解(jie)除勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)。 這里(li),對勞(lao)(lao)動(dong)(dong)(dong)者(zhe)是(shi)(shi)否需要(yao)合適(shi)的理由沒有明確規(gui)(gui)定(ding)。也(ye)就是(shi)(shi)說,該條規(gui)(gui)定(ding)實際上(shang)確認了(le)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)合法(fa)的自主辭(ci)職(zhi)權。勞(lao)(lao)動(dong)(dong)(dong)者(zhe)根據自身情況(kuang)或者(zhe)個(ge)人發展需要(yao),需要(yao)解(jie)除勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)的,只(zhi)要(yao)提前30日以書(shu)面形式通知用人單位,即可以解(jie)除勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)。 但(dan)是(shi)(shi),如(ru)果勞(lao)(lao)動(dong)(dong)(dong)者(zhe)因個(ge)人原因解(jie)除勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)違反了(le)勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)中的相(xiang)關約(yue)定(ding),構(gou)成違約(yue),則還(huan)應(ying)承擔(dan)相(xiang)應(ying)的違約(yue)責任(比如(ru)關于服(fu)務期(qi)的約(yue)定(ding))。
