《勞動合同法》有沒有規定勞動者的辭職自主權?

我年(nian)前(qian)找了一份新工作,感覺自己不(bu)適合,想辭職,勞動者有辭職自主(zhu)權(quan)嗎?

《勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同法》第37條規定(ding):勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者提(ti)前30日以書(shu)面(mian)形式(shi)通知用人(ren)單位(wei),可以解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同。 這里,對勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者是(shi)否需要(yao)(yao)(yao)合(he)(he)適的(de)(de)(de)理(li)由沒(mei)有明(ming)確規定(ding)。也(ye)就是(shi)說,該條規定(ding)實際(ji)上確認了勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者合(he)(he)法的(de)(de)(de)自(zi)主辭職權。勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者根(gen)據(ju)自(zi)身情況或者個(ge)人(ren)發展(zhan)需要(yao)(yao)(yao),需要(yao)(yao)(yao)解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同的(de)(de)(de),只(zhi)要(yao)(yao)(yao)提(ti)前30日以書(shu)面(mian)形式(shi)通知用人(ren)單位(wei),即可以解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同。 但是(shi),如(ru)果勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者因(yin)(yin)個(ge)人(ren)原因(yin)(yin)解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同違反了勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同中的(de)(de)(de)相(xiang)關(guan)約定(ding),構成(cheng)違約,則(ze)還應承擔(dan)相(xiang)應的(de)(de)(de)違約責任(ren)(比如(ru)關(guan)于服務期的(de)(de)(de)約定(ding))。
