試用期離職還需要交違約金嗎?
問 我(wo)是一(yi)名(ming)會計師,正(zheng)在(zai)濟南一(yi)家超市工作,現在(zai)還在(zai)試用期,單位(wei)里家太(tai)遠(yuan)了,想換份(fen)工作,試用期離職還需要交違約金嗎?
答 《勞(lao)(lao)動(dong)(dong)(dong)法(fa)》第三十(shi)二條(tiao)之規定,勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)在試(shi)用(yong)(yong)期(qi)內可(ke)以隨(sui)時(shi)(shi)通知用(yong)(yong)人單(dan)位解除勞(lao)(lao)動(dong)(dong)(dong)合(he)同。勞(lao)(lao)動(dong)(dong)(dong)法(fa)賦予了勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)試(shi)用(yong)(yong)期(qi)隨(sui)時(shi)(shi)解除勞(lao)(lao)動(dong)(dong)(dong)合(he)同的(de)權力,且該解除權是(shi)無條(tiao)件的(de)。用(yong)(yong)人單(dan)位在勞(lao)(lao)動(dong)(dong)(dong)合(he)同中約(yue)定勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)在試(shi)用(yong)(yong)期(qi)解除合(he)同需(xu)承(cheng)擔違約(yue)責任實(shi)際上(shang)限(xian)制了勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)的(de)解除權,因此該約(yue)定侵害了勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)的(de)合(he)法(fa)權利,違反(fan)了法(fa)律的(de)規定,應(ying)當確(que)認(ren)為無效條(tiao)款。
