答 勞(lao)(lao)動(dong)(dong)合(he)同中,對試用(yong)(yong)(yong)期解約的(de)(de)(de)規(gui)定(ding)有(you)限制,企業對勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)不(bu)能(neng)(neng)(neng)說(shuo)辭(ci)就辭(ci)。勞(lao)(lao)動(dong)(dong)法規(gui)定(ding),試用(yong)(yong)(yong)期用(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)可解除勞(lao)(lao)動(dong)(dong)合(he)同的(de)(de)(de)情形只(zhi)有(you)以下(xia)幾種: 1、在試用(yong)(yong)(yong)期間(jian)被(bei)證明不(bu)符(fu)合(he)錄(lu)用(yong)(yong)(yong)條件的(de)(de)(de); 2、重違(wei)反用(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)的(de)(de)(de)規(gui)章制度的(de)(de)(de);嚴(yan)重失職,營(ying)私舞弊(bi),給用(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)造成(cheng)重大損害的(de)(de)(de); 3、勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)同時與其他用(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)建立勞(lao)(lao)動(dong)(dong)關系(xi),對完成(cheng)本單(dan)(dan)位(wei)的(de)(de)(de)工作任務造成(cheng)嚴(yan)重影響(xiang),或者(zhe)(zhe)(zhe)經用(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)提出(chu),拒不(bu)改(gai)正(zheng)的(de)(de)(de); 4、因(yin)《勞(lao)(lao)動(dong)(dong)合(he)同法》第二(er)十六條第一款第一項規(gui)定(ding)的(de)(de)(de)情形致使(shi)勞(lao)(lao)動(dong)(dong)合(he)同無(wu)效的(de)(de)(de);被(bei)依法追究刑(xing)事(shi)責任的(de)(de)(de); 5、勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)患病或者(zhe)(zhe)(zhe)非因(yin)工負傷,在規(gui)定(ding)的(de)(de)(de)醫療期滿后不(bu)能(neng)(neng)(neng)從(cong)事(shi)原(yuan)工作,也不(bu)能(neng)(neng)(neng)從(cong)事(shi)由用(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)另行安排的(de)(de)(de)工作的(de)(de)(de);勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)不(bu)能(neng)(neng)(neng)勝任工作,經過(guo)培訓或者(zhe)(zhe)(zhe)調整工作崗位(wei),仍不(bu)能(neng)(neng)(neng)勝任工作的(de)(de)(de)。
