答 勞(lao)動(dong)(dong)合同中,對試用(yong)(yong)期解約的(de)(de)(de)規(gui)(gui)定(ding)(ding)有限制,企業(ye)對勞(lao)動(dong)(dong)者不(bu)(bu)(bu)能(neng)(neng)說辭就辭。勞(lao)動(dong)(dong)法規(gui)(gui)定(ding)(ding),試用(yong)(yong)期用(yong)(yong)人(ren)(ren)單位(wei)(wei)可解除勞(lao)動(dong)(dong)合同的(de)(de)(de)情形(xing)只有以下幾種: 1、在(zai)試用(yong)(yong)期間(jian)被(bei)證明(ming)不(bu)(bu)(bu)符合錄用(yong)(yong)條件的(de)(de)(de); 2、重(zhong)(zhong)違反(fan)用(yong)(yong)人(ren)(ren)單位(wei)(wei)的(de)(de)(de)規(gui)(gui)章制度的(de)(de)(de);嚴(yan)重(zhong)(zhong)失職,營私舞(wu)弊,給用(yong)(yong)人(ren)(ren)單位(wei)(wei)造成重(zhong)(zhong)大損害的(de)(de)(de); 3、勞(lao)動(dong)(dong)者同時(shi)與其他用(yong)(yong)人(ren)(ren)單位(wei)(wei)建立勞(lao)動(dong)(dong)關系,對完成本單位(wei)(wei)的(de)(de)(de)工作(zuo)任務造成嚴(yan)重(zhong)(zhong)影響(xiang),或者經(jing)用(yong)(yong)人(ren)(ren)單位(wei)(wei)提(ti)出(chu),拒不(bu)(bu)(bu)改正的(de)(de)(de); 4、因《勞(lao)動(dong)(dong)合同法》第二十六條第一款第一項規(gui)(gui)定(ding)(ding)的(de)(de)(de)情形(xing)致使勞(lao)動(dong)(dong)合同無效的(de)(de)(de);被(bei)依法追究刑事責任的(de)(de)(de); 5、勞(lao)動(dong)(dong)者患病或者非因工負(fu)傷,在(zai)規(gui)(gui)定(ding)(ding)的(de)(de)(de)醫療期滿(man)后(hou)不(bu)(bu)(bu)能(neng)(neng)從事原工作(zuo),也不(bu)(bu)(bu)能(neng)(neng)從事由用(yong)(yong)人(ren)(ren)單位(wei)(wei)另行安排(pai)的(de)(de)(de)工作(zuo)的(de)(de)(de);勞(lao)動(dong)(dong)者不(bu)(bu)(bu)能(neng)(neng)勝(sheng)任工作(zuo),經(jing)過培訓(xun)或者調整工作(zuo)崗位(wei)(wei),仍不(bu)(bu)(bu)能(neng)(neng)勝(sheng)任工作(zuo)的(de)(de)(de)。
