單位主動和員工解除合同是不是應該給予補償?

我在濟南一(yi)家私(si)企工(gong)(gong)作,今(jin)年公司產品滯銷,很多員工(gong)(gong)都被辭退了,單位(wei)主動和員工(gong)(gong)解除合同(tong)是(shi)不是(shi)應(ying)該給予(yu)補償?

根據《勞(lao)動(dong)(dong)合(he)同(tong)(tong)法(fa)》規(gui)定,用人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)(wei)與勞(lao)動(dong)(dong)者協商(shang)(shang)一致(zhi),由用人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)(wei)向(xiang)勞(lao)動(dong)(dong)者提(ti)(ti)出(chu)解(jie)(jie)除(chu)(chu)勞(lao)動(dong)(dong)合(he)同(tong)(tong)的(de),用人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)(wei)應當(dang)向(xiang)勞(lao)動(dong)(dong)者支付(fu)經(jing)濟(ji)補(bu)償(chang)(chang)金(jin)(jin)。 可(ke)見,即使在協商(shang)(shang)一致(zhi)的(de)情況(kuang)下(xia),由用人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)(wei)提(ti)(ti)出(chu)解(jie)(jie)除(chu)(chu)勞(lao)動(dong)(dong)合(he)同(tong)(tong)的(de),單(dan)(dan)(dan)(dan)位(wei)(wei)(wei)應當(dang)支付(fu)經(jing)濟(ji)補(bu)償(chang)(chang)金(jin)(jin);而(er)由勞(lao)動(dong)(dong)者提(ti)(ti)出(chu)解(jie)(jie)除(chu)(chu)勞(lao)動(dong)(dong)合(he)同(tong)(tong)的(de),單(dan)(dan)(dan)(dan)位(wei)(wei)(wei)則可(ke)以不支付(fu)經(jing)濟(ji)補(bu)償(chang)(chang)金(jin)(jin)。 但是(shi),在其他情況(kuang)下(xia),如果系由用人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)(wei)的(de)過錯原因,由勞(lao)動(dong)(dong)者被迫(po)提(ti)(ti)出(chu)解(jie)(jie)除(chu)(chu)勞(lao)動(dong)(dong)合(he)同(tong)(tong)的(de),用人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)(wei)仍(reng)應支付(fu)經(jing)濟(ji)補(bu)償(chang)(chang)金(jin)(jin)。
