問(wen) 我(wo)是一(yi)名機械師,在(zai)山(shan)東省一(yi)家私企工(gong)作,最近公(gong)司效益不(bu)好(hao),經常(chang)有(you)人被辭(ci)退,企業和哪些員工(gong)解除合同要支付經濟補償?

《勞(lao)(lao)(lao)動(dong)(dong)合(he)同法》第40條規(gui)定:在以下三種情形下,用人單位(wei)向勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)提出解除勞(lao)(lao)(lao)動(dong)(dong)合(he)同時(shi),應支付經(jing)濟(ji)補償金: (1)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)患病或(huo)者(zhe)(zhe)(zhe)非因工(gong)(gong)負(fu)傷,在規(gui)定的(de)醫療期滿后(hou)不(bu)能(neng)從事(shi)原工(gong)(gong)作(zuo),也不(bu)能(neng)從事(shi)由用人單位(wei)另行(xing)安排的(de)工(gong)(gong)作(zuo)的(de); (2)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)不(bu)能(neng)勝任(ren)工(gong)(gong)作(zuo),經(jing)過培訓或(huo)者(zhe)(zhe)(zhe)調整(zheng)工(gong)(gong)作(zuo)崗(gang)位(wei),仍(reng)不(bu)能(neng)勝任(ren)工(gong)(gong)作(zuo)的(de); (3)勞(lao)(lao)(lao)動(dong)(dong)合(he)同訂立時(shi)所依據的(de)客觀情況發(fa)生重大變化,致使勞(lao)(lao)(lao)動(dong)(dong)合(he)同無法履行(xing),經(jing)用人單位(wei)與勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)協商,未能(neng)就變更勞(lao)(lao)(lao)動(dong)(dong)合(he)同內容達成協議的(de)。
