企業和哪些員工解除合同要支付經濟補償?

我是(shi)一(yi)名機械師,在山東省一(yi)家(jia)私企工作,最近公司效益不(bu)好(hao),經常有人被(bei)辭退(tui),企業(ye)和哪(na)些員工解除合(he)同(tong)要支(zhi)付(fu)經濟補償?

答(da) 《勞(lao)(lao)動(dong)(dong)(dong)合(he)同法》第40條規定:在以下三種(zhong)情(qing)形下,用(yong)(yong)人單位向勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)提出解除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同時(shi),應支付經(jing)濟(ji)補償金: (1)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)患病或(huo)者(zhe)(zhe)非因工(gong)(gong)(gong)負傷,在規定的(de)醫療(liao)期滿后不(bu)(bu)能(neng)從事(shi)(shi)原工(gong)(gong)(gong)作(zuo),也不(bu)(bu)能(neng)從事(shi)(shi)由用(yong)(yong)人單位另行安排的(de)工(gong)(gong)(gong)作(zuo)的(de); (2)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)不(bu)(bu)能(neng)勝(sheng)任工(gong)(gong)(gong)作(zuo),經(jing)過培訓或(huo)者(zhe)(zhe)調整工(gong)(gong)(gong)作(zuo)崗(gang)位,仍不(bu)(bu)能(neng)勝(sheng)任工(gong)(gong)(gong)作(zuo)的(de); (3)勞(lao)(lao)動(dong)(dong)(dong)合(he)同訂(ding)立(li)時(shi)所依(yi)據的(de)客觀情(qing)況發生重大變化,致使勞(lao)(lao)動(dong)(dong)(dong)合(he)同無法履行,經(jing)用(yong)(yong)人單位與勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)協商(shang),未能(neng)就變更勞(lao)(lao)動(dong)(dong)(dong)合(he)同內容達成協議的(de)。
