就業協議書可以代替勞動合同嗎?

我(wo)畢(bi)業(ye)前跟用人(ren)單位簽(qian)了(le)(le)就業(ye)協(xie)(xie)議(yi),現在畢(bi)業(ye)了(le)(le),正(zheng)式上班了(le)(le),我(wo)問(wen)什么時候(hou)簽(qian)勞(lao)動合(he)同(tong)(tong),單位領導說,已經簽(qian)了(le)(le)就業(ye)協(xie)(xie)議(yi)書了(le)(le)就不(bu)用簽(qian)勞(lao)動合(he)同(tong)(tong)了(le)(le),請問(wen)就業(ye)協(xie)(xie)議(yi)書可以(yi)代替勞(lao)動合(he)同(tong)(tong)嗎?

“就業協議書(shu)”不能代替勞動(dong)(dong)合同(tong)(tong),單憑“就業協議書(shu)”,學生正式報(bao)到就業后的勞動(dong)(dong)權利(li)無法得到保障。《勞動(dong)(dong)合同(tong)(tong)法》第十條(tiao)明(ming)確規定,“建(jian)立(li)(li)勞動(dong)(dong)關(guan)系,應當訂(ding)立(li)(li)書(shu)面(mian)勞動(dong)(dong)合同(tong)(tong)。已(yi)建(jian)立(li)(li)勞動(dong)(dong)關(guan)系,未同(tong)(tong)時訂(ding)立(li)(li)書(shu)面(mian)勞動(dong)(dong)合同(tong)(tong)的,應當自(zi)用工(gong)之日起(qi)一個月內訂(ding)立(li)(li)書(shu)面(mian)勞動(dong)(dong)合同(tong)(tong)。”
