單位不與勞動者簽訂書面勞動合同,該受到什么懲罰?

我都工作兩個月了,單位還(huan)沒有與我簽訂書(shu)面勞(lao)動(dong)(dong)(dong)合同(tong),請問單位不與勞(lao)動(dong)(dong)(dong)者(zhe)簽訂書(shu)面勞(lao)動(dong)(dong)(dong)合同(tong),該受到什么懲(cheng)罰(fa)?

《勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)法》規(gui)定(ding),用(yong)人單位自用(yong)工之日起(qi)(qi)超過(guo)一個月不滿一年未與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)訂(ding)(ding)立書面勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)的,應(ying)(ying)當向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)每月支(zhi)付二倍(bei)的工資(zi);用(yong)人單位違反本(ben)法規(gui)定(ding)不與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)訂(ding)(ding)立無(wu)固定(ding)期(qi)限(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)的,自應(ying)(ying)當訂(ding)(ding)立無(wu)固定(ding)期(qi)限(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)之日起(qi)(qi)向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)每月支(zhi)付二倍(bei)的工資(zi)。因此,單位如果未依(yi)法與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)訂(ding)(ding)立勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong),除應(ying)(ying)向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)支(zhi)付其應(ying)(ying)得的工資(zi)以(yi)外,還需再支(zhi)付一倍(bei)的工資(zi)作為對勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)的補償(chang)。
