單位不與勞動者簽訂書面勞動合同,該受到什么懲罰?

《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)》規定(ding),用人單(dan)(dan)位自(zi)用工之日起超過一個月(yue)不滿一年未與勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)訂(ding)(ding)(ding)立(li)書面勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)的(de),應當向勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)每(mei)月(yue)支(zhi)付二(er)倍的(de)工資(zi);用人單(dan)(dan)位違(wei)反(fan)本法(fa)規定(ding)不與勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)訂(ding)(ding)(ding)立(li)無(wu)固定(ding)期限勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)的(de),自(zi)應當訂(ding)(ding)(ding)立(li)無(wu)固定(ding)期限勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)之日起向勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)每(mei)月(yue)支(zhi)付二(er)倍的(de)工資(zi)。因(yin)此,單(dan)(dan)位如果未依法(fa)與勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)訂(ding)(ding)(ding)立(li)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong),除(chu)應向勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)支(zhi)付其應得的(de)工資(zi)以外,還需再(zai)支(zhi)付一倍的(de)工資(zi)作為對勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)的(de)補償。
