畢業生簽勞動合同要注意什么?

我(wo)是今年(nian)的(de)應屆(jie)畢(bi)業生,剛找到工作,明天就要(yao)與單位簽勞動(dong)合同(tong)了, 請問畢(bi)業生簽勞動(dong)合同(tong)要(yao)注(zhu)意(yi)什么?

簽勞(lao)動(dong)合(he)同(tong)時除了要(yao)(yao)注意合(he)同(tong)上的(de)(de)(de)(de)一(yi)些基本信息,如工(gong)作地點、時間等,還要(yao)(yao)注意四個(ge)(ge)(ge)方面: 一(yi)要(yao)(yao)明(ming)確職務和(he)崗(gang)位(wei)(wei),否(fou)則,用(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)可(ke)能(neng)(neng)會利用(yong)(yong)調職的(de)(de)(de)(de)方式(shi),變相壓迫(po)你(ni)主動(dong)辭(ci)職,不支付(fu)任何(he)經(jing)濟補償金打發你(ni); 二要(yao)(yao)防止(zhi)用(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)不斷用(yong)(yong)換(huan)崗(gang)位(wei)(wei)的(de)(de)(de)(de)方式(shi),反復延長試用(yong)(yong)期,因為同(tong)一(yi)個(ge)(ge)(ge)崗(gang)位(wei)(wei)同(tong)一(yi)個(ge)(ge)(ge)人(ren)(ren)不能(neng)(neng)適(shi)用(yong)(yong)兩次試用(yong)(yong)期,而換(huan)崗(gang)位(wei)(wei)就沒有限制了(其實這(zhe)招已經(jing)不用(yong)(yong)再防了,《勞(lao)動(dong)合(he)同(tong)法(fa)》規定(ding),同(tong)一(yi)用(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)與同(tong)一(yi)勞(lao)動(dong)者只能(neng)(neng)約定(ding)一(yi)次試用(yong)(yong)期); 三要(yao)(yao)在(zai)勞(lao)動(dong)合(he)同(tong)中(zhong)明(ming)確最低(di)的(de)(de)(de)(de)工(gong)資(zi)標準,最好能(neng)(neng)將年終獎(jiang)用(yong)(yong)條(tiao)款固定(ding)下(xia)來,作為工(gong)資(zi)的(de)(de)(de)(de)一(yi)部分。由于我國暫時沒有對年終獎(jiang)定(ding)性(xing),這(zhe)個(ge)(ge)(ge)法(fa)律空白(bai)有可(ke)能(neng)(neng)被(bei)用(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)利用(yong)(yong),將來成(cheng)為克扣薪水的(de)(de)(de)(de)一(yi)種方式(shi); 四要(yao)(yao)了解用(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)是否(fou)給員工(gong)辦理社會保(bao)(bao)險(xian)。如果(guo)沒有社保(bao)(bao),等于工(gong)資(zi)減去很多(duo),還不能(neng)(neng)享受國家(jia)和(he)單(dan)(dan)位(wei)(wei)的(de)(de)(de)(de)社保(bao)(bao)福利。
