勞動合同期滿后未續簽用人單位應支付雙倍工資嗎?

問 我(wo)的(de)勞動合同期上(shang)周已滿,現在(zai)單位(wei)還沒有與我(wo)續簽,請問是不是該支(zhi)付給我(wo)雙(shuang)倍(bei)工資呢?
答 “用(yong)人單(dan)位自用(yong)工(gong)之日起超過一(yi)個月(yue)不滿一(yi)年未與勞動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)訂立(li)書面勞動(dong)(dong)(dong)(dong)合(he)同(tong)的”的條(tiao)件,適(shi)用(yong)“雙倍(bei)罰則”。所以,勞動(dong)(dong)(dong)(dong)合(he)同(tong)到期(qi)后,勞動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)若(ruo)繼續在用(yong)人單(dan)位工(gong)作,用(yong)人單(dan)位超過一(yi)個月(yue)未滿一(yi)年未與勞動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)簽訂勞動(dong)(dong)(dong)(dong)合(he)同(tong)的,應向勞動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)每月(yue)支付(fu)雙倍(bei)工(gong)資。
