用人單位先試用后簽勞動合同合理嗎?

來工作(zuo)一個(ge)星期(qi)了還(huan)沒簽勞動(dong)合(he)同,問上(shang)司,上(shang)司說先試用(yong)后簽勞動(dong)合(he)同,請問這樣合(he)理嗎?

不(bu)合(he)理(li)。“試(shi)用(yong)(yong)期(qi)(qi)(qi)”是(shi)指用(yong)(yong)人(ren)單(dan)位和勞(lao)動(dong)(dong)者為相(xiang)互了解(jie)、選擇而約定(ding)的考(kao)察(cha)期(qi)(qi)(qi)。根據勞(lao)動(dong)(dong)法(fa)(fa)等相(xiang)關法(fa)(fa)律、法(fa)(fa)規規定(ding),用(yong)(yong)人(ren)單(dan)位可以與勞(lao)動(dong)(dong)者約定(ding)試(shi)用(yong)(yong)期(qi)(qi)(qi),但試(shi)用(yong)(yong)期(qi)(qi)(qi)應包括在勞(lao)動(dong)(dong)合(he)同期(qi)(qi)(qi)限內,用(yong)(yong)人(ren)單(dan)位不(bu)能先試(shi)用(yong)(yong)后(hou)簽訂勞(lao)動(dong)(dong)合(he)同。
