職工拒簽合同,單位終止勞動關系時還用付補償嗎?

我們單位(wei)有職工拒簽(qian)勞動(dong)合同,請問如果(guo)單位(wei)終止勞動(dong)關系,還用付補償嗎?

答(da) 根據《勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)法實(shi)施條例》第5條規(gui)定,自(zi)用(yong)工之(zhi)日(ri)起一個月內,經用(yong)人單(dan)位書(shu)面(mian)通知后,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)不與(yu)用(yong)人單(dan)位訂立書(shu)面(mian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)的(de),用(yong)人單(dan)位應當書(shu)面(mian)通知勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)終止勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關系(xi),無需(xu)向勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)支(zhi)付經濟補償,但是應當依法向勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)支(zhi)付其(qi)實(shi)際工作時間的(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)報酬(chou)。
