員工在試用期內請長病假,企業可以延長試用期嗎?

我們單位(wei)有員工在(zai)試(shi)用(yong)期(qi)內請(qing)長(chang)病假(jia),請(qing)問企(qi)業可以(yi)延長(chang)其試(shi)用(yong)期(qi)嗎(ma)?

試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)必須約(yue)定(ding)在勞(lao)(lao)動(dong)合同中,沒有勞(lao)(lao)動(dong)合同,或(huo)者口頭約(yue)定(ding)的(de)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)都不(bu)作(zuo)數。至于試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)內病(bing)假時間長,是(shi)(shi)否可(ke)(ke)以延長試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi),要看兩個方面(mian)。一(yi)是(shi)(shi)法律規定(ding)的(de)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)上(shang)限(xian)。一(yi)年的(de)勞(lao)(lao)動(dong)合同只能設(she)立兩個月的(de)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi),那就(jiu)不(bu)能再(zai)延長。如果(guo)是(shi)(shi)三(san)年勞(lao)(lao)動(dong)合同,試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)上(shang)限(xian)是(shi)(shi)六(liu)個月,那就(jiu)看第二(er)個方面(mian):雙方協商(shang)一(yi)致(zhi)。雙方協商(shang)一(yi)致(zhi)可(ke)(ke)以變更勞(lao)(lao)動(dong)合同,試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)作(zuo)為勞(lao)(lao)動(dong)合同的(de)條款之一(yi),也可(ke)(ke)以變更,因此(ci),在不(bu)突破法律上(shang)限(xian)的(de)情(qing)況下,雙方協商(shang)一(yi)致(zhi),可(ke)(ke)以延長試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)。
