員工在試用期內請長病假,企業可以延長試用期嗎?

我們(men)單位有(you)員工在試用期內(nei)請長(chang)病假(jia),請問企業(ye)可以延長(chang)其(qi)試用期嗎?

試(shi)(shi)用(yong)(yong)(yong)期(qi)必須約定(ding)在勞(lao)動(dong)(dong)合(he)同(tong)中,沒有勞(lao)動(dong)(dong)合(he)同(tong),或者口頭約定(ding)的試(shi)(shi)用(yong)(yong)(yong)期(qi)都不作(zuo)(zuo)數。至(zhi)于(yu)試(shi)(shi)用(yong)(yong)(yong)期(qi)內病假(jia)時間長,是(shi)(shi)否(fou)可(ke)以延長試(shi)(shi)用(yong)(yong)(yong)期(qi),要看(kan)兩個方(fang)面。一(yi)是(shi)(shi)法律(lv)規定(ding)的試(shi)(shi)用(yong)(yong)(yong)期(qi)上(shang)限。一(yi)年的勞(lao)動(dong)(dong)合(he)同(tong)只能設(she)立兩個月的試(shi)(shi)用(yong)(yong)(yong)期(qi),那(nei)就(jiu)不能再延長。如果是(shi)(shi)三年勞(lao)動(dong)(dong)合(he)同(tong),試(shi)(shi)用(yong)(yong)(yong)期(qi)上(shang)限是(shi)(shi)六個月,那(nei)就(jiu)看(kan)第二個方(fang)面:雙(shuang)方(fang)協商一(yi)致(zhi)。雙(shuang)方(fang)協商一(yi)致(zhi)可(ke)以變更勞(lao)動(dong)(dong)合(he)同(tong),試(shi)(shi)用(yong)(yong)(yong)期(qi)作(zuo)(zuo)為勞(lao)動(dong)(dong)合(he)同(tong)的條款之一(yi),也可(ke)以變更,因此(ci),在不突破法律(lv)上(shang)限的情況下,雙(shuang)方(fang)協商一(yi)致(zhi),可(ke)以延長試(shi)(shi)用(yong)(yong)(yong)期(qi)。
