勞動合同中約定將社保費直接付給員工有效嗎?

我下周一就要簽(qian)勞動合同(tong)了,想(xiang)問一下大家勞動合同(tong)中約定將(jiang)社保(bao)費直接付給(gei)員工有效嗎?

《勞動(dong)(dong)法(fa)》規定,“用(yong)(yong)人(ren)單(dan)位和勞動(dong)(dong)者(zhe)必須(xu)(xu)依法(fa)參(can)加(jia)(jia)社(she)(she)(she)會(hui)(hui)保(bao)險(xian)”。可見(jian),社(she)(she)(she)會(hui)(hui)保(bao)險(xian)具有強(qiang)(qiang)制(zhi)性,依法(fa)參(can)加(jia)(jia)社(she)(she)(she)會(hui)(hui)保(bao)險(xian),繳(jiao)納保(bao)險(xian)費(fei)用(yong)(yong),是(shi)用(yong)(yong)人(ren)單(dan)位和勞動(dong)(dong)者(zhe)的法(fa)定責任和義(yi)務。只要用(yong)(yong)人(ren)單(dan)位和勞動(dong)(dong)者(zhe)依法(fa)確(que)立了勞動(dong)(dong)關系,用(yong)(yong)人(ren)單(dan)位就必須(xu)(xu)參(can)加(jia)(jia)社(she)(she)(she)會(hui)(hui)保(bao)險(xian),按照社(she)(she)(she)會(hui)(hui)保(bao)險(xian)的項目、保(bao)險(xian)費(fei)繳(jiao)納的方(fang)(fang)式和標準(zhun)、保(bao)險(xian)待遇(yu)的內(nei)容和標準(zhun)等,為(wei)員工辦理參(can)加(jia)(jia)社(she)(she)(she)會(hui)(hui)保(bao)險(xian)的相(xiang)關手續。由(you)于(yu)參(can)加(jia)(jia)社(she)(she)(she)會(hui)(hui)保(bao)險(xian)是(shi)法(fa)律(lv)規定的強(qiang)(qiang)制(zhi)性義(yi)務,因(yin)此,其不因(yin)雙方(fang)(fang)當事人(ren)的任何(he)約定而被排除。所以,勞動(dong)(dong)合同中(zhong)約定將社(she)(she)(she)保(bao)費(fei)直接付給員工是(shi)無效的。
