違反勞動合同該承擔什么責任?

答 一般約(yue)(yue)(yue)(yue)(yue)定(ding)(ding)兩種(zhong)違(wei)(wei)約(yue)(yue)(yue)(yue)(yue)責任形(xing)式,第一種(zhong)是(shi)一方(fang)違(wei)(wei)約(yue)(yue)(yue)(yue)(yue)賠(pei)償(chang)(chang)給對(dui)方(fang)造成經濟損(sun)失(shi),即賠(pei)償(chang)(chang)損(sun)失(shi)的方(fang)式;二是(shi)約(yue)(yue)(yue)(yue)(yue)定(ding)(ding)違(wei)(wei)約(yue)(yue)(yue)(yue)(yue)金的計算方(fang)法,采用違(wei)(wei)約(yue)(yue)(yue)(yue)(yue)金方(fang)式應當注意(yi)根據職(zhi)工一方(fang)承(cheng)受能力(li)來(lai)約(yue)(yue)(yue)(yue)(yue)定(ding)(ding)具體金額,避免(mian)出現顯(xian)失(shi)公(gong)平(ping)的情(qing)形(xing)。違(wei)(wei)約(yue)(yue)(yue)(yue)(yue),不是(shi)指一般性的違(wei)(wei)約(yue)(yue)(yue)(yue)(yue),而(er)是(shi)指嚴重違(wei)(wei)約(yue)(yue)(yue)(yue)(yue),致使(shi)勞動合(he)同(tong)無(wu)法繼(ji)續履行,如職(zhi)工違(wei)(wei)約(yue)(yue)(yue)(yue)(yue)離(li)職(zhi),單位違(wei)(wei)法解除勞動者(zhe)合(he)同(tong)等。
