聘書就等于簽訂了勞動合同嗎?

前一段時(shi)間我(wo)面(mian)試了一家濟南的公(gong)司,前天收到了公(gong)司的聘書(shu),還到公(gong)司簽了字蓋(gai)了章,這(zhe)樣就相(xiang)當于簽訂了勞動(dong)合(he)同嗎(ma)?

聘書不具有(you)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)效力。勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)法第十七條(tiao)規(gui)定(ding):“勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)應當(dang)具備(bei)以(yi)下(xia)條(tiao)款:(一(yi))用人(ren)單位的(de)名稱、住(zhu)所和(he)法定(ding)代表人(ren)或者主要負責人(ren);(二)勞(lao)(lao)動(dong)(dong)(dong)者的(de)姓名、住(zhu)址和(he)居民(min)身(shen)份(fen)證(zheng)或者其他有(you)效身(shen)份(fen)證(zheng)件(jian)(jian)號碼;(三)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)期限(xian);(四)工作內容和(he)工作地點;(五)工作時間和(he)休息休假(jia);(六)勞(lao)(lao)動(dong)(dong)(dong)報酬;(七)社會保(bao)險;(八(ba))勞(lao)(lao)動(dong)(dong)(dong)保(bao)護、勞(lao)(lao)動(dong)(dong)(dong)條(tiao)件(jian)(jian)和(he)職業(ye)危(wei)害防護;(九)法律(lv)、法規(gui)規(gui)定(ding)應當(dang)納入勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)其他事項。”現實中,如(ru)果聘書的(de)內容具備(bei)了上(shang)述(shu)必備(bei)條(tiao)款,勞(lao)(lao)動(dong)(dong)(dong)者也已經直接簽(qian)字(zi)認(ren)可,表明雙方對勞(lao)(lao)動(dong)(dong)(dong)關系的(de)權利義務(wu)協商一(yi)致(zhi),聘書因轉化成了勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong),而(er)具備(bei)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)效力;如(ru)果勞(lao)(lao)動(dong)(dong)(dong)者未簽(qian)字(zi)認(ren)可,則意(yi)味(wei)著(zhu)尚未具有(you)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)效力。
