無固定期限勞動合同是不是“終身”制的?
問 我是(shi)(shi)一名(ming)技術(shu)工人,在目前這家公(gong)(gong)司工作十(shi)年了,公(gong)(gong)司明年就要和(he)我簽(qian)訂無固(gu)定期(qi)限(xian)勞動合(he)(he)同了,無固(gu)定期(qi)限(xian)勞動合(he)(he)同是(shi)(shi)不是(shi)(shi)“終(zhong)身”制的?
答(da) 訂(ding)立無(wu)固(gu)定(ding)(ding)(ding)期限(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)的(de)(de)簽(qian)訂(ding)條件是: (一)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)已在(zai)該用(yong)人(ren)(ren)單(dan)位(wei)連續工(gong)(gong)作(zuo)(zuo)滿十(shi)(shi)年(nian)的(de)(de); (二)用(yong)人(ren)(ren)單(dan)位(wei)初次實行勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)制(zhi)度(du)或(huo)者(zhe)(zhe)(zhe)(zhe)國有(you)企業改(gai)制(zhi)重新訂(ding)立勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)時,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)在(zai)該用(yong)人(ren)(ren)單(dan)位(wei)連續工(gong)(gong)作(zuo)(zuo)滿十(shi)(shi)年(nian)且距法(fa)定(ding)(ding)(ding)退休年(nian)齡(ling)不足十(shi)(shi)年(nian)的(de)(de); (三)連續訂(ding)立二次固(gu)定(ding)(ding)(ding)期限(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)且勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)沒(mei)有(you)本法(fa)第三十(shi)(shi)九條規(gui)定(ding)(ding)(ding)的(de)(de)情(qing)形(xing)續訂(ding)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)的(de)(de)。 無(wu)固(gu)定(ding)(ding)(ding)期限(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)(tong)并不是“終(zhong)身”制(zhi)的(de)(de),在(zai)履行合(he)同(tong)(tong)(tong)(tong)過程中,出(chu)現法(fa)定(ding)(ding)(ding)解(jie)除(chu)合(he)同(tong)(tong)(tong)(tong)情(qing)形(xing),用(yong)人(ren)(ren)單(dan)位(wei)有(you)權(quan)解(jie)除(chu)合(he)同(tong)(tong)(tong)(tong)。
