無固定期限勞動合同是不是“終身”制的?

答(da) 訂(ding)立無(wu)固(gu)定期限勞(lao)動(dong)(dong)(dong)合(he)同(tong)的簽訂(ding)條件是: (一)勞(lao)動(dong)(dong)(dong)者(zhe)已在該用(yong)人(ren)(ren)單位(wei)連(lian)續工作滿(man)十(shi)(shi)年(nian)的; (二(er))用(yong)人(ren)(ren)單位(wei)初次(ci)實(shi)行勞(lao)動(dong)(dong)(dong)合(he)同(tong)制度(du)或者(zhe)國有企業改制重新訂(ding)立勞(lao)動(dong)(dong)(dong)合(he)同(tong)時,勞(lao)動(dong)(dong)(dong)者(zhe)在該用(yong)人(ren)(ren)單位(wei)連(lian)續工作滿(man)十(shi)(shi)年(nian)且距法(fa)定退休年(nian)齡不足十(shi)(shi)年(nian)的; (三(san))連(lian)續訂(ding)立二(er)次(ci)固(gu)定期限勞(lao)動(dong)(dong)(dong)合(he)同(tong)且勞(lao)動(dong)(dong)(dong)者(zhe)沒(mei)有本法(fa)第三(san)十(shi)(shi)九條規(gui)定的情形續訂(ding)勞(lao)動(dong)(dong)(dong)合(he)同(tong)的。 無(wu)固(gu)定期限勞(lao)動(dong)(dong)(dong)合(he)同(tong)并不是“終身”制的,在履行合(he)同(tong)過程中,出現法(fa)定解(jie)除合(he)同(tong)情形,用(yong)人(ren)(ren)單位(wei)有權解(jie)除合(he)同(tong)。
