最(zui)低(di)工資(zi)是指勞動(dong)(dong)(dong)者在法定工作時(shi)(shi)間或依(yi)法簽訂的勞動(dong)(dong)(dong)合同(tong)約定的工作時(shi)(shi)間內提供了正常勞動(dong)(dong)(dong)的前提下,用人單位(wei)依(yi)法應支付的最(zui)低(di)勞動(dong)(dong)(dong)報酬。月(yue)最(zui)低(di)工資(zi)標(biao)準(zhun)適用于全日(ri)(ri)制就業勞動(dong)(dong)(dong)者,小(xiao)時(shi)(shi)最(zui)低(di)工資(zi)標(biao)準(zhun)適用于非全日(ri)(ri)制就業勞動(dong)(dong)(dong)者。
日前,德州(zhou)市人(ren)社局發布通知,自2014年(nian)3月1日起,德州(zhou)月最低工資標(biao)準由(you)1080元(yuan)(yuan)調整(zheng)為1200元(yuan)(yuan),小(xiao)時最低工資標(biao)準由(you)11元(yuan)(yuan)調整(zheng)為12元(yuan)(yuan)。
我省自2014年3月份起(qi)再次調(diao)整(zheng)最(zui)低(di)(di)工(gong)(gong)資(zi)標(biao)(biao)準(zhun)(zhun),最(zui)低(di)(di)工(gong)(gong)資(zi)標(biao)(biao)準(zhun)(zhun)根(gen)據各地的經濟發展水平分為(wei)(wei)3檔,其(qi)中德州市月最(zui)低(di)(di)工(gong)(gong)資(zi)為(wei)(wei)1200元,最(zui)低(di)(di)小時(shi)工(gong)(gong)資(zi)為(wei)(wei)12元。此前,德州市最(zui)低(di)(di)工(gong)(gong)資(zi)標(biao)(biao)準(zhun)(zhun)為(wei)(wei)1080元,小時(shi)最(zui)低(di)(di)工(gong)(gong)資(zi)標(biao)(biao)準(zhun)(zhun)為(wei)(wei)11元。
“每個(ge)(ge)月(yue)1200元(yuan)或者每個(ge)(ge)小時12元(yuan),是(shi)少(shao)數生產經營困難、經濟效益下(xia)降、確(que)無正常(chang)工(gong)(gong)資(zi)(zi)支(zhi)(zhi)付能力(li)的(de)用(yong)(yong)人(ren)單位支(zhi)(zhi)付給勞(lao)動者的(de)最(zui)低(di)勞(lao)動報(bao)酬,至少(shao)是(shi)連續(xu)3個(ge)(ge)月(yue)以上不能正常(chang)發放(fang)工(gong)(gong)資(zi)(zi)的(de)。”德(de)州(zhou)市人(ren)社局勞(lao)動關系科工(gong)(gong)作(zuo)人(ren)員介紹,“有支(zhi)(zhi)付能力(li)的(de)用(yong)(yong)人(ren)單位不得將最(zui)低(di)工(gong)(gong)資(zi)(zi)作(zuo)為正常(chang)的(de)工(gong)(gong)資(zi)(zi)支(zhi)(zhi)付標準,如(ru)果用(yong)(yong)人(ren)單位需要按最(zui)低(di)工(gong)(gong)資(zi)(zi)標準支(zhi)(zhi)付工(gong)(gong)資(zi)(zi),應履行必要的(de)民(min)主程序并事先報(bao)同級人(ren)力(li)資(zi)(zi)源(yuan)社會保障(zhang)行政部門備案。”
勞動(dong)者個人(ren)應當(dang)繳(jiao)納的(de)(de)社會保險費和(he)住房(fang)公積金包含在最低(di)(di)工(gong)資(zi)(zi)標準之內。值得注意的(de)(de)是,延(yan)長工(gong)作時(shi)間的(de)(de)加班加點工(gong)資(zi)(zi),中班、夜班、高溫、低(di)(di)溫、井下、有(you)毒有(you)害等(deng)特殊工(gong)作環境、條件下的(de)(de)津貼,以及法(fa)律、法(fa)規和(he)國家、省規定的(de)(de)勞動(dong)者應當(dang)享受的(de)(de)福(fu)利待遇不(bu)包含在最低(di)(di)工(gong)資(zi)(zi)標準的(de)(de)項(xiang)目內。
