煙臺芝罘最低工資標準 適用群體包括農民工

煙(yan)臺(tai)芝罘區(qu)(qu)人力(li)資源和社會保障(zhang)局近日公布了新的最低工資標(biao)準,芝罘區(qu)(qu)最低工資標(biao)準由(you)原來(lai)的1380元(yuan)(yuan)調整(zheng)到(dao)1500元(yuan)(yuan),小時最低工資標(biao)準由(you)原來(lai)的14.5元(yuan)(yuan)調整(zheng)到(dao)15元(yuan)(yuan),新標(biao)準現已實行。

按照(zhao)國家(jia)有(you)關(guan)法(fa)(fa)律法(fa)(fa)規和政策,最(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)(gong)資標(biao)準(zhun)是(shi)勞(lao)動(dong)(dong)(dong)(dong)(dong)者在法(fa)(fa)定(ding)(ding)工(gong)(gong)(gong)(gong)(gong)作(zuo)時(shi)(shi)(shi)(shi)間或依(yi)(yi)(yi)(yi)法(fa)(fa)簽訂(ding)的(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)約定(ding)(ding)的(de)工(gong)(gong)(gong)(gong)(gong)作(zuo)時(shi)(shi)(shi)(shi)間內提(ti)供了正常(chang)勞(lao)動(dong)(dong)(dong)(dong)(dong)的(de)前提(ti)下,用(yong)(yong)(yong)人單(dan)位(wei)(wei)依(yi)(yi)(yi)(yi)法(fa)(fa)應支(zhi)付(fu)的(de)最(zui)低(di)(di)(di)勞(lao)動(dong)(dong)(dong)(dong)(dong)報酬(chou)。最(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)(gong)資規定(ding)(ding)適用(yong)(yong)(yong)于(yu)各(ge)類企(qi)(qi)業(ye)、民辦非(fei)(fei)(fei)企(qi)(qi)業(ye)單(dan)位(wei)(wei)、有(you)雇工(gong)(gong)(gong)(gong)(gong)的(de)個(ge)體(ti)工(gong)(gong)(gong)(gong)(gong)商戶(hu)(統稱用(yong)(yong)(yong)人單(dan)位(wei)(wei))和與之形成勞(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)系的(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)者,包括農(nong)民工(gong)(gong)(gong)(gong)(gong)。月最(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)(gong)資標(biao)準(zhun)適用(yong)(yong)(yong)于(yu)全(quan)日(ri)制(zhi)(zhi)就(jiu)業(ye)勞(lao)動(dong)(dong)(dong)(dong)(dong)者,小(xiao)時(shi)(shi)(shi)(shi)最(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)(gong)資標(biao)準(zhun)適用(yong)(yong)(yong)于(yu)非(fei)(fei)(fei)全(quan)日(ri)制(zhi)(zhi)就(jiu)業(ye)勞(lao)動(dong)(dong)(dong)(dong)(dong)者。非(fei)(fei)(fei)全(quan)日(ri)制(zhi)(zhi)就(jiu)業(ye)是(shi)指以小(xiao)時(shi)(shi)(shi)(shi)計酬(chou)為主,勞(lao)動(dong)(dong)(dong)(dong)(dong)者在同(tong)一(yi)用(yong)(yong)(yong)人單(dan)位(wei)(wei)平(ping)均每日(ri)工(gong)(gong)(gong)(gong)(gong)作(zuo)時(shi)(shi)(shi)(shi)間不超過(guo)4小(xiao)時(shi)(shi)(shi)(shi),每周(zhou)累(lei)計不超過(guo)24小(xiao)時(shi)(shi)(shi)(shi)的(de)用(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)形式。正常(chang)勞(lao)動(dong)(dong)(dong)(dong)(dong)是(shi)勞(lao)動(dong)(dong)(dong)(dong)(dong)者按依(yi)(yi)(yi)(yi)法(fa)(fa)簽訂(ding)的(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)約定(ding)(ding),在法(fa)(fa)定(ding)(ding)工(gong)(gong)(gong)(gong)(gong)作(zuo)時(shi)(shi)(shi)(shi)間或勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)約定(ding)(ding)的(de)工(gong)(gong)(gong)(gong)(gong)作(zuo)時(shi)(shi)(shi)(shi)間內從事的(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)。勞(lao)動(dong)(dong)(dong)(dong)(dong)者依(yi)(yi)(yi)(yi)法(fa)(fa)享受帶薪(xin)年休假(jia)(jia)、探(tan)親假(jia)(jia)、婚喪假(jia)(jia)、生育(產)假(jia)(jia)、節(jie)育手術假(jia)(jia)等國家(jia)規定(ding)(ding)的(de)假(jia)(jia)期間,以及(ji)法(fa)(fa)定(ding)(ding)工(gong)(gong)(gong)(gong)(gong)作(zuo)時(shi)(shi)(shi)(shi)間內依(yi)(yi)(yi)(yi)法(fa)(fa)參加社(she)會(hui)活動(dong)(dong)(dong)(dong)(dong)期間,視(shi)為提(ti)供了正常(chang)勞(lao)動(dong)(dong)(dong)(dong)(dong)。勞(lao)動(dong)(dong)(dong)(dong)(dong)者個(ge)人應當繳(jiao)納的(de)社(she)會(hui)保險費和住房公積金,包含在最(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)(gong)資標(biao)準(zhun)之內。

最低工(gong)資(zi)標(biao)準不包(bao)括延(yan)長工(gong)作時間、休息日(ri)工(gong)作和法定(ding)(ding)(ding)節假(jia)日(ri)工(gong)作的(de)(de)加(jia)班工(gong)資(zi);中(zhong)班、夜班、高溫(wen)、低溫(wen)、井下、有(you)毒有(you)害等(deng)特殊工(gong)作環境、條(tiao)件下的(de)(de)津貼;法律、法規(gui)(gui)(gui)和國(guo)家、省規(gui)(gui)(gui)定(ding)(ding)(ding)的(de)(de)勞(lao)動者應享受的(de)(de)福(fu)利待(dai)遇。最低工(gong)資(zi)標(biao)準主(zhu)要包(bao)括對勞(lao)動者進行培訓的(de)(de)費用(yong)(yong);按國(guo)家勞(lao)動安全衛生(sheng)規(gui)(gui)(gui)定(ding)(ding)(ding)發給勞(lao)動者的(de)(de)費用(yong)(yong)和用(yong)(yong)品,以及(ji)用(yong)(yong)人(ren)(ren)單位(wei)自(zi)身規(gui)(gui)(gui)定(ding)(ding)(ding)的(de)(de)工(gong)作用(yong)(yong)品(如工(gong)作著裝等(deng));按國(guo)家住房制度(du)改革(ge)規(gui)(gui)(gui)定(ding)(ding)(ding)由用(yong)(yong)人(ren)(ren)單位(wei)為(wei)勞(lao)動者繳納的(de)(de)住房公積金;用(yong)(yong)人(ren)(ren)單位(wei)為(wei)勞(lao)動者支付的(de)(de)醫療(liao)衛生(sheng)費、喪葬撫恤救濟(ji)金、探親(qin)路費、計劃生(sheng)育補貼、生(sheng)活困難(nan)補助、冬季取暖補貼、夏季防暑降(jiang)溫(wen)費等(deng)。

用(yong)人(ren)單(dan)位(wei)因生產經(jing)營(ying)困(kun)難,確需(xu)按照最低(di)工(gong)(gong)資(zi)(zi)標(biao)準支付勞動者工(gong)(gong)資(zi)(zi)的,應當履行(xing)必要的民主程序(經(jing)職工(gong)(gong)代表大會(hui)(hui)或(huo)(huo)職工(gong)(gong)大會(hui)(hui)討論(lun)通過),并報人(ren)力資(zi)(zi)源社會(hui)(hui)保障部門備案。用(yong)人(ren)單(dan)位(wei)生產經(jing)營(ying)恢復(fu)(fu)正常后,應及時(shi)恢復(fu)(fu)或(huo)(huo)提高工(gong)(gong)資(zi)(zi)標(biao)準。
