煙臺芝(zhi)罘區(qu)人力資(zi)源和社會保障局(ju)近(jin)日公布(bu)了新的最低(di)工(gong)資(zi)標(biao)準,芝(zhi)罘區(qu)最低(di)工(gong)資(zi)標(biao)準由原來的1380元調整到1500元,小時最低(di)工(gong)資(zi)標(biao)準由原來的14.5元調整到15元,新標(biao)準現已實行(xing)。
按照國家有(you)關法(fa)(fa)律法(fa)(fa)規和(he)政(zheng)策,最(zui)低(di)工(gong)(gong)(gong)(gong)資(zi)(zi)標準(zhun)是勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)在法(fa)(fa)定(ding)(ding)工(gong)(gong)(gong)(gong)作時(shi)(shi)(shi)(shi)間(jian)(jian)或(huo)依(yi)(yi)法(fa)(fa)簽(qian)訂(ding)(ding)的(de)(de)勞(lao)(lao)動(dong)(dong)合同(tong)約(yue)(yue)定(ding)(ding)的(de)(de)工(gong)(gong)(gong)(gong)作時(shi)(shi)(shi)(shi)間(jian)(jian)內(nei)(nei)提供了(le)正常(chang)勞(lao)(lao)動(dong)(dong)的(de)(de)前提下,用(yong)(yong)人單(dan)(dan)位(wei)(wei)(wei)依(yi)(yi)法(fa)(fa)應(ying)支付的(de)(de)最(zui)低(di)勞(lao)(lao)動(dong)(dong)報酬(chou)。最(zui)低(di)工(gong)(gong)(gong)(gong)資(zi)(zi)規定(ding)(ding)適(shi)用(yong)(yong)于各類企(qi)業(ye)、民(min)辦非企(qi)業(ye)單(dan)(dan)位(wei)(wei)(wei)、有(you)雇工(gong)(gong)(gong)(gong)的(de)(de)個(ge)體(ti)工(gong)(gong)(gong)(gong)商戶(統稱用(yong)(yong)人單(dan)(dan)位(wei)(wei)(wei))和(he)與之形(xing)成勞(lao)(lao)動(dong)(dong)關系的(de)(de)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe),包括農民(min)工(gong)(gong)(gong)(gong)。月最(zui)低(di)工(gong)(gong)(gong)(gong)資(zi)(zi)標準(zhun)適(shi)用(yong)(yong)于全日制就業(ye)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe),小時(shi)(shi)(shi)(shi)最(zui)低(di)工(gong)(gong)(gong)(gong)資(zi)(zi)標準(zhun)適(shi)用(yong)(yong)于非全日制就業(ye)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)。非全日制就業(ye)是指以小時(shi)(shi)(shi)(shi)計酬(chou)為主(zhu),勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)在同(tong)一(yi)用(yong)(yong)人單(dan)(dan)位(wei)(wei)(wei)平均每日工(gong)(gong)(gong)(gong)作時(shi)(shi)(shi)(shi)間(jian)(jian)不(bu)(bu)超過4小時(shi)(shi)(shi)(shi),每周累計不(bu)(bu)超過24小時(shi)(shi)(shi)(shi)的(de)(de)用(yong)(yong)工(gong)(gong)(gong)(gong)形(xing)式。正常(chang)勞(lao)(lao)動(dong)(dong)是勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)按依(yi)(yi)法(fa)(fa)簽(qian)訂(ding)(ding)的(de)(de)勞(lao)(lao)動(dong)(dong)合同(tong)約(yue)(yue)定(ding)(ding),在法(fa)(fa)定(ding)(ding)工(gong)(gong)(gong)(gong)作時(shi)(shi)(shi)(shi)間(jian)(jian)或(huo)勞(lao)(lao)動(dong)(dong)合同(tong)約(yue)(yue)定(ding)(ding)的(de)(de)工(gong)(gong)(gong)(gong)作時(shi)(shi)(shi)(shi)間(jian)(jian)內(nei)(nei)從事的(de)(de)勞(lao)(lao)動(dong)(dong)。勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)依(yi)(yi)法(fa)(fa)享受帶薪年休假(jia)(jia)、探(tan)親假(jia)(jia)、婚喪假(jia)(jia)、生育(產(chan))假(jia)(jia)、節育手術(shu)假(jia)(jia)等國家規定(ding)(ding)的(de)(de)假(jia)(jia)期(qi)間(jian)(jian),以及法(fa)(fa)定(ding)(ding)工(gong)(gong)(gong)(gong)作時(shi)(shi)(shi)(shi)間(jian)(jian)內(nei)(nei)依(yi)(yi)法(fa)(fa)參加(jia)社會活動(dong)(dong)期(qi)間(jian)(jian),視為提供了(le)正常(chang)勞(lao)(lao)動(dong)(dong)。勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)個(ge)人應(ying)當繳(jiao)納的(de)(de)社會保險費和(he)住房公積(ji)金,包含在最(zui)低(di)工(gong)(gong)(gong)(gong)資(zi)(zi)標準(zhun)之內(nei)(nei)。
最低(di)工(gong)資(zi)標準不包(bao)(bao)括延長工(gong)作(zuo)時間、休息日工(gong)作(zuo)和法定節假日工(gong)作(zuo)的(de)(de)(de)加班(ban)工(gong)資(zi);中班(ban)、夜班(ban)、高溫(wen)、低(di)溫(wen)、井下、有毒(du)有害等(deng)(deng)特殊(shu)工(gong)作(zuo)環境、條件(jian)下的(de)(de)(de)津(jin)貼;法律、法規(gui)(gui)(gui)和國家(jia)、省規(gui)(gui)(gui)定的(de)(de)(de)勞(lao)(lao)(lao)動(dong)者(zhe)應(ying)享受的(de)(de)(de)福利待遇。最低(di)工(gong)資(zi)標準主(zhu)要(yao)包(bao)(bao)括對勞(lao)(lao)(lao)動(dong)者(zhe)進(jin)行培訓的(de)(de)(de)費(fei)(fei)用(yong);按(an)國家(jia)勞(lao)(lao)(lao)動(dong)安全(quan)衛生(sheng)(sheng)(sheng)規(gui)(gui)(gui)定發給(gei)勞(lao)(lao)(lao)動(dong)者(zhe)的(de)(de)(de)費(fei)(fei)用(yong)和用(yong)品,以及用(yong)人(ren)單(dan)位自身(shen)規(gui)(gui)(gui)定的(de)(de)(de)工(gong)作(zuo)用(yong)品(如(ru)工(gong)作(zuo)著裝等(deng)(deng));按(an)國家(jia)住房(fang)制(zhi)度改(gai)革規(gui)(gui)(gui)定由用(yong)人(ren)單(dan)位為勞(lao)(lao)(lao)動(dong)者(zhe)繳納的(de)(de)(de)住房(fang)公(gong)積金(jin);用(yong)人(ren)單(dan)位為勞(lao)(lao)(lao)動(dong)者(zhe)支付(fu)的(de)(de)(de)醫(yi)療衛生(sheng)(sheng)(sheng)費(fei)(fei)、喪葬撫(fu)恤救濟金(jin)、探(tan)親路費(fei)(fei)、計劃生(sheng)(sheng)(sheng)育補(bu)(bu)貼、生(sheng)(sheng)(sheng)活困難補(bu)(bu)助(zhu)、冬季取(qu)暖(nuan)補(bu)(bu)貼、夏季防暑降溫(wen)費(fei)(fei)等(deng)(deng)。
用人(ren)單(dan)位因生產經(jing)營(ying)困難,確需按照最低工(gong)資標準支(zhi)付勞動(dong)者工(gong)資的,應當履行(xing)必(bi)要的民主(zhu)程(cheng)序(經(jing)職(zhi)工(gong)代表大會(hui)或職(zhi)工(gong)大會(hui)討論通過),并報人(ren)力資源社會(hui)保障(zhang)部門備案。用人(ren)單(dan)位生產經(jing)營(ying)恢(hui)復正(zheng)常后,應及時恢(hui)復或提高(gao)工(gong)資標準。
