2個(ge)建(jian)筑企業(ye)被清(qing)(qing)出章(zhang)丘(qiu)市場(chang),3個(ge)被限期(qi)6個(ge)月(yue)整改,10個(ge)記(ji)入不良記(ji)錄,2位非法(fa)勞務承包隊伍負責人被清(qing)(qing)出章(zhang)丘(qiu)市場(chang)……在3月(yue)7日召開(kai)的山東章(zhang)丘(qiu)建(jian)筑業(ye)2013年工(gong)作總結表彰(zhang)暨(ji)2014年春季建(jian)筑市場(chang)執法(fa)大檢查啟動(dong)會上,20余家單位因拖欠農(nong)民工(gong)工(gong)資被曝(pu)光并受嚴懲。該(gai)市針對“討薪難(nan)”這一頑疾,創新(xin)工(gong)作方(fang)法(fa),建(jian)立農(nong)民工(gong)工(gong)資結算月(yue)公(gong)示(shi)制度,變(bian)清(qing)(qing)欠為防欠,力保農(nong)民工(gong)合(he)法(fa)權益。
防欠追責 用工實名 從源頭堵住欠薪的“跑冒滴漏”
每到歲末年尾,農民工(gong)討薪成為一個敏(min)感話題(ti)。年年都幫農民工(gong)討薪,但是欠薪問題(ti)仍然是“春風吹又(you)生(sheng)”,如何(he)才能從根源解決(jue),經(jing)過調(diao)研總結(jie)前期的(de)(de)經(jing)驗教訓(xun),章丘初步探索出了(le)一條(tiao)切(qie)實可行的(de)(de)路徑。
責(ze)任主體(ti)明確(que),“誰(shui)承(cheng)(cheng)包、誰(shui)負責(ze)”,總(zong)承(cheng)(cheng)包企業(ye)對所承(cheng)(cheng)包工(gong)(gong)(gong)(gong)程的(de)農(nong)(nong)民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)支付(fu)管理(li)工(gong)(gong)(gong)(gong)作負總(zong)責(ze),項(xiang)目經理(li)為項(xiang)目第(di)一責(ze)任人,具體(ti)負責(ze)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)支付(fu)管理(li),因各種原因致拖欠農(nong)(nong)民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)的(de),由工(gong)(gong)(gong)(gong)程總(zong)承(cheng)(cheng)包企業(ye)承(cheng)(cheng)擔(dan)清(qing)欠責(ze)任。嚴格落實(shi)建筑(zhu)施(shi)工(gong)(gong)(gong)(gong)企業(ye)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)保證金、勞(lao)保金的(de)繳存(cun),對工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)實(shi)行(xing)“兜底(di)”。實(shi)行(xing)進場施(shi)工(gong)(gong)(gong)(gong)實(shi)名制管理(li),實(shi)現(xian)(xian)施(shi)工(gong)(gong)(gong)(gong)現(xian)(xian)場勞(lao)動用工(gong)(gong)(gong)(gong)底(di)數清(qing)、基(ji)本情況清(qing)、出勤記(ji)錄(lu)清(qing)、工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)發放記(ji)錄(lu)清(qing)、進出項(xiang)目時間(jian)清(qing)等“五(wu)清(qing)”目標的(de)管理(li)制度。推(tui)行(xing)農(nong)(nong)民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)結算(suan)月(yue)公示(shi)制度。每月(yue)月(yue)底(di)前根據出勤及完成的(de)實(shi)物(wu)量情況,計算(suan)農(nong)(nong)民工(gong)(gong)(gong)(gong)應得月(yue)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)額,由總(zong)承(cheng)(cheng)包企業(ye)、分包單位和農(nong)(nong)民工(gong)(gong)(gong)(gong)簽(qian)字認可后在(zai)施(shi)工(gong)(gong)(gong)(gong)現(xian)(xian)場公示(shi)。
嚴(yan)把入口(kou)關,對入章施工企業(ye),必(bi)(bi)須持有(you)合法(fa)(fa)有(you)效的外地企業(ye)進濟備案證(zheng)、資質注冊(ce)地建設行政(zheng)主管部(bu)門出具的無拖欠農民工工資不(bu)良行為(wei)證(zheng)明(ming)材料。同時在領(ling)取中標通(tong)知(zhi)書時,必(bi)(bi)須提供加蓋總承包單(dan)位公章且有(you)單(dan)位法(fa)(fa)人及項(xiang)目經理簽名的承諾(nuo)不(bu)拖欠農民工工資保證(zheng)書。
建立5支巡查小組 全面督導落實 實現清欠的常態化
“先(xian)防欠(qian),再清(qing)欠(qian),由清(qing)欠(qian)辦(ban)牽頭(tou),從機(ji)關(guan)各(ge)科室(shi)、后勤部門抽調工(gong)(gong)作(zuo)人員成立5個(ge)巡(xun)視小組,對全市581個(ge)建筑項(xiang)(xiang)目(mu)工(gong)(gong)地進行定(ding)期走訪,監督每(mei)月農民工(gong)(gong)工(gong)(gong)資(zi)(zi)支(zhi)付及公示情況情況,將(jiang)農民工(gong)(gong)工(gong)(gong)資(zi)(zi)清(qing)欠(qian)工(gong)(gong)作(zuo)常態化,制度化。”章丘住(zhu)建委(wei)相(xiang)關(guan)負責人表(biao)示。若發(fa)現相(xiang)關(guan)總承(cheng)包企業不按(an)規定(ding)報送農民工(gong)(gong)工(gong)(gong)資(zi)(zi)發(fa)放表(biao)、考勤表(biao),不按(an)規定(ding)按(an)月支(zhi)付農民工(gong)(gong)工(gong)(gong)資(zi)(zi)及未公示工(gong)(gong)資(zi)(zi)表(biao)的工(gong)(gong)程項(xiang)(xiang)目(mu),一律停工(gong)(gong)整改,經住(zhu)建委(wei)清(qing)欠(qian)辦(ban)復核合格后方可恢復施工(gong)(gong),情節嚴重的,將(jiang)對責任(ren)單位及責任(ren)人,按(an)相(xiang)關(guan)規定(ding)予(yu)以處(chu)罰(fa)。
進(jin)一(yi)步切實(shi)履行(xing)“屬(shu)地管(guan)理”職責。各鎮、街道辦(ban)(ban)對(dui)本轄區(qu)的新(xin)型(xing)農村社區(qu)建設(she)(she)、舊村改造工(gong)(gong)程加強監督檢(jian)查,做好農民工(gong)(gong)工(gong)(gong)資拖(tuo)欠問題日常排查,及(ji)早發現(xian)和(he)處(chu)置(zhi)勞資糾(jiu)紛(fen)。經濟開發區(qu)、工(gong)(gong)業園(yuan)區(qu),要進(jin)一(yi)步強化對(dui)引(yin)進(jin)引(yin)辦(ban)(ban)企業的監督管(guan)理,督促各企業按照(zhao)基本建設(she)(she)程序完善(shan)相關建設(she)(she)手續,同時做好農民工(gong)(gong)工(gong)(gong)資支(zhi)付管(guan)理工(gong)(gong)作。
把農民工當親人 發揮建筑業主體能動性
2014年,章丘市立足教育實踐活(huo)動,做(zuo)實事、轉作(zuo)風、求實效。在全市建筑行業,力求突(tu)破農(nong)(nong)民(min)(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)清欠難題,做(zuo)服(fu)務、轉思想、促(cu)創(chuang)新(xin)。多措(cuo)并舉,讓農(nong)(nong)民(min)(min)工(gong)(gong)(gong)(gong)真正體會到變(bian)化(hua)(hua),做(zuo)農(nong)(nong)民(min)(min)工(gong)(gong)(gong)(gong)“娘家(jia)人”,創(chuang)新(xin)清欠工(gong)(gong)(gong)(gong)作(zuo)機制,月月公示(shi)農(nong)(nong)民(min)(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi),天天監督工(gong)(gong)(gong)(gong)資(zi)發放,時時預防農(nong)(nong)民(min)(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)拖(tuo)欠,把(ba)清欠工(gong)(gong)(gong)(gong)作(zuo)常態化(hua)(hua),保障農(nong)(nong)民(min)(min)工(gong)(gong)(gong)(gong)權益(yi)。
