一是(shi)試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)期(qi)(qi)(qi)限(xian)過(guo)(guo)長(chang)(chang)。試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)期(qi)(qi)(qi)限(xian)并非可長(chang)(chang)可短,勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)條例規(gui)(gui)定(ding)(ding),勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)不(bu)超(chao)(chao)過(guo)(guo)6個月,試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)不(bu)得超(chao)(chao)過(guo)(guo)15天;勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)在6個月至1年(nian)期(qi)(qi)(qi)間(jian)的(de)(de),試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)不(bu)超(chao)(chao)過(guo)(guo)30天;勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)在1年(nian)至3年(nian)期(qi)(qi)(qi)間(jian)的(de)(de),試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)不(bu)超(chao)(chao)過(guo)(guo)60天。如(ru)果(guo)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)擅(shan)自延(yan)長(chang)(chang)試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi),且(qie)在其(qi)規(gui)(gui)定(ding)(ding)的(de)(de)試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)內卻是(shi)法律規(gui)(gui)定(ding)(ding)的(de)(de)試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)外(wai)提(ti)出(chu)解除(chu)合(he)同(tong)(tong)(tong),勞(lao)動(dong)(dong)者(zhe)(zhe)(zhe)(zhe)可向有關部門提(ti)請申訴(su),維護(hu)自己的(de)(de)權益。 二(er)是(shi)要求勞(lao)動(dong)(dong)者(zhe)(zhe)(zhe)(zhe)在試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)內承擔違約責任。 三(san)是(shi)僅(jin)僅(jin)訂(ding)立一份試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)合(he)同(tong)(tong)(tong)。如(ru)果(guo)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)僅(jin)與(yu)勞(lao)動(dong)(dong)者(zhe)(zhe)(zhe)(zhe)簽訂(ding)一份試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)合(he)同(tong)(tong)(tong),勞(lao)動(dong)(dong)者(zhe)(zhe)(zhe)(zhe)就相(xiang)當(dang)于正(zheng)式員工(gong)(gong),如(ru)果(guo)用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)要解聘(pin)勞(lao)動(dong)(dong)者(zhe)(zhe)(zhe)(zhe),則應按(an)照程序給出(chu)正(zheng)式的(de)(de)解聘(pin)理(li)由(you),勞(lao)動(dong)(dong)者(zhe)(zhe)(zhe)(zhe)還可以獲得一定(ding)(ding)的(de)(de)經濟(ji)補償。 四是(shi)試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)工(gong)(gong)資(zi)(zi)低(di)于當(dang)地的(de)(de)最低(di)工(gong)(gong)資(zi)(zi)水平。 五是(shi)試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)內用(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)不(bu)繳納社會保(bao)險費用(yong)(yong)(yong)。 六是(shi)試(shi)(shi)(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)內無正(zheng)當(dang)理(li)由(you)辭退勞(lao)動(dong)(dong)者(zhe)(zhe)(zhe)(zhe)。
