沒簽勞動合同可以隨時離職么?

我(wo)(wo)來公(gong)司上班一個多(duo)月了,一直(zhi)沒(mei)有跟我(wo)(wo)簽合同,請問,我(wo)(wo)現(xian)在(zai)想離職還需(xu)要提(ti)前一個月申請么?

《勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)法(fa)》第(di)10條(tiao)規定(ding):建(jian)立(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)關系(xi),應當訂立(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)。已建(jian)立(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)關系(xi),未同(tong)(tong)時(shi)訂立(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)的,應當自(zi)用工之日起一(yi)個月內訂立(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)。第(di)30條(tiao)規定(ding):用人單位應當按(an)照(zhao)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)約定(ding)和國家(jia)規定(ding),向勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)及(ji)時(shi)足額支付(fu)勞(lao)(lao)(lao)(lao)動(dong)(dong)報酬(chou)。由此可見,該公司不與勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)簽訂勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)、不給勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)繳納社會保險(xian)費本身(shen)就是違法(fa)的,勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)有權隨時(shi)辭職,無需提(ti)前一(yi)個月申(shen)請。
