沒簽勞動合同可以隨時離職么?

我來(lai)公司(si)上班一個(ge)多月(yue)了,一直沒有跟我簽合同,請問,我現在(zai)想離職還需(xu)要提前一個(ge)月(yue)申請么?

《勞動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)法(fa)》第10條規定:建(jian)立(li)勞動(dong)(dong)(dong)關(guan)系,應當(dang)訂立(li)書(shu)面勞動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)。已建(jian)立(li)勞動(dong)(dong)(dong)關(guan)系,未(wei)同(tong)(tong)時(shi)訂立(li)書(shu)面勞動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de),應當(dang)自用工之日(ri)起一個月(yue)內訂立(li)書(shu)面勞動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)。第30條規定:用人單(dan)位應當(dang)按照(zhao)勞動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)約定和國家規定,向勞動(dong)(dong)(dong)者(zhe)(zhe)及時(shi)足(zu)額(e)支(zhi)付(fu)勞動(dong)(dong)(dong)報(bao)酬。由此可見,該公司(si)不與勞動(dong)(dong)(dong)者(zhe)(zhe)簽訂勞動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)、不給勞動(dong)(dong)(dong)者(zhe)(zhe)繳納社會保險(xian)費本(ben)身(shen)就是違法(fa)的(de),勞動(dong)(dong)(dong)者(zhe)(zhe)有權隨時(shi)辭職,無需提前一個月(yue)申(shen)請。
