預告性(xing)辭退(tui)(tui)是指企業在辭退(tui)(tui)職工(gong)(gong)時(shi),按照法律(lv)的(de)(de)(de)規定(ding)提(ti)前(qian)30天通(tong)知職工(gong)(gong)或支付代替通(tong)知金的(de)(de)(de)方式辭退(tui)(tui)職工(gong)(gong)的(de)(de)(de)行為。主(zhu)要有(you)以下(xia)情(qing)形(xing): (1)勞(lao)動(dong)者患(huan)病或非因工(gong)(gong)負傷,醫療期滿(man)后,不能從(cong)事原(yuan)工(gong)(gong)作(zuo)也不能從(cong)事用位另(ling)行安排的(de)(de)(de)工(gong)(gong)作(zuo); (2)勞(lao)動(dong)者不能勝任工(gong)(gong)作(zuo),經過培訓或者調整工(gong)(gong)作(zuo)崗位,仍不能勝任工(gong)(gong)作(zuo); (3)勞(lao)動(dong)合同訂(ding)立時(shi)所依據的(de)(de)(de)客(ke)觀情(qing)況發生(sheng)重大變(bian)化,致使勞(lao)動(dong)合同無法履行,經雙(shuang)方協商(shang)不能就變(bian)更(geng)勞(lao)動(dong)合同達(da)成(cheng)協議的(de)(de)(de)。
