辭職未提前30天通知單位會被扣工資嗎?

《勞(lao)(lao)動(dong)(dong)(dong)法》第(di)3條規定,勞(lao)(lao)動(dong)(dong)(dong)者享有取得勞(lao)(lao)動(dong)(dong)(dong)報(bao)酬的權利。《工(gong)資(zi)支付(fu)(fu)暫行規定》第(di)9條規定,勞(lao)(lao)動(dong)(dong)(dong)關系雙方(fang)依(yi)法解(jie)除(chu)或終(zhong)止勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)時(shi),用人(ren)單位(wei)應在解(jie)除(chu)或終(zhong)止勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)時(shi)一(yi)次付(fu)(fu)清(qing)勞(lao)(lao)動(dong)(dong)(dong)者工(gong)資(zi)。勞(lao)(lao)動(dong)(dong)(dong)者提(ti)供了勞(lao)(lao)動(dong)(dong)(dong),用人(ren)單位(wei)應當支付(fu)(fu)勞(lao)(lao)動(dong)(dong)(dong)報(bao)酬,解(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)關系時(shi)雙方(fang)應當結清(qing)工(gong)資(zi)。工(gong)資(zi)作為(wei)正常勞(lao)(lao)動(dong)(dong)(dong)所得,在無法定情形(xing)下,用人(ren)單位(wei)無權扣除(chu)工(gong)資(zi)。
