口頭申請離職,是否生效?

答 《勞(lao)(lao)動(dong)合(he)同(tong)法》第三(san)十七條規定,勞(lao)(lao)動(dong)者(zhe)提(ti)前三(san)十日以書面形(xing)式(shi)通(tong)知(zhi)用人單位,可以解除勞(lao)(lao)動(dong)合(he)同(tong)。從(cong)該條可看出,書面通(tong)知(zhi)并(bing)不是(shi)強制性規范,勞(lao)(lao)動(dong)者(zhe)可以以口頭(tou)形(xing)式(shi)申請離職(zhi)(zhi),口頭(tou)申請離職(zhi)(zhi)也是(shi)表(biao)達意思表(biao)示的(de)一(yi)(yi)種(zhong)方式(shi)。實(shi)踐中,很多員工就是(shi)以口頭(tou)形(xing)式(shi)向(xiang)公(gong)司提(ti)出辭(ci)職(zhi)(zhi)的(de),公(gong)司一(yi)(yi)般也認可這種(zhong)口頭(tou)申請辭(ci)職(zhi)(zhi)的(de)方式(shi)。
