單位要求辭職者立刻離職怎么辦?

我(wo)因為在(zai)工作中犯了錯(cuo)誤,公司讓我(wo)立即(ji)辭職,想咨詢一(yi)下,這樣(yang)做合理(li)么?

員工(gong)辭(ci)職在勞(lao)(lao)動(dong)(dong)(dong)法(fa)(fa)中(zhong)稱為“勞(lao)(lao)動(dong)(dong)(dong)者單(dan)方面解(jie)除勞(lao)(lao)動(dong)(dong)(dong)合同(tong)”。《中(zhong)華人民(min)共和(he)國勞(lao)(lao)動(dong)(dong)(dong)合同(tong)法(fa)(fa)》第三十七條規(gui)定(ding):“勞(lao)(lao)動(dong)(dong)(dong)者提(ti)(ti)(ti)(ti)前三十日以(yi)書(shu)面形式(shi)通知用人單(dan)位,可以(yi)解(jie)除勞(lao)(lao)動(dong)(dong)(dong)合同(tong)。”簡單(dan)的(de)一句話,已是(shi)對員工(gong)正(zheng)常辭(ci)職的(de)全(quan)部要(yao)求(qiu)。 這(zhe)一辭(ci)職的(de)請(qing)求(qiu)權(quan)(quan)是(shi)在員工(gong)手(shou)中(zhong)的(de),員工(gong)不提(ti)(ti)(ti)(ti)出,單(dan)位不能迫使員工(gong)提(ti)(ti)(ti)(ti)出;這(zhe)一請(qing)求(qiu)權(quan)(quan)需要(yao)以(yi)書(shu)面形式(shi)提(ti)(ti)(ti)(ti)出,任(ren)何的(de)口(kou)頭辭(ci)職不能產生(sheng)勞(lao)(lao)動(dong)(dong)(dong)法(fa)(fa)上解(jie)除勞(lao)(lao)動(dong)(dong)(dong)合同(tong)的(de)效(xiao)果;而這(zhe)一請(qing)求(qiu)權(quan)(quan)是(shi)員工(gong)預期自(zi)(zi)己(ji)還需要(yao)工(gong)作(zuo)30天的(de)前提(ti)(ti)(ti)(ti)下提(ti)(ti)(ti)(ti)出的(de),如果單(dan)位擅自(zi)(zi)改變這(zhe)一預期,顯(xian)然和(he)員工(gong)提(ti)(ti)(ti)(ti)出辭(ci)職的(de)意(yi)愿是(shi)不一致的(de)。
