最近回老家了(le),不想回公司上(shang)班(ban)了(le),請問,電子(zi)聊天記錄(lu)辭職有法律效(xiao)應嗎(ma)?

《中華(hua)人(ren)(ren)民共(gong)和國勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法》第(di)三(san)十(shi)七條規定:“勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)提前三(san)十(shi)日以書(shu)面(mian)形式通(tong)知用(yong)(yong)(yong)人(ren)(ren)單位,可(ke)以解(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)。勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)在試用(yong)(yong)(yong)期內提前三(san)日通(tong)知用(yong)(yong)(yong)人(ren)(ren)單位,可(ke)以解(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)。”這里(li)有(you)兩個(ge)要點: 一是(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)必(bi)須提前三(san)十(shi)天(tian)通(tong)知。這里(li)的三(san)十(shi)天(tian),是(shi)指(zhi)提出離職后(hou),還要為用(yong)(yong)(yong)人(ren)(ren)單位工作三(san)十(shi)天(tian),一來是(shi)讓用(yong)(yong)(yong)人(ren)(ren)單位有(you)時(shi)間(jian)找(zhao)到勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)的繼任者(zhe),二是(shi)讓勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)完成手頭事務的后(hou)續工作和交接。 二是(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)的通(tong)知必(bi)須以書(shu)面(mian)形式。
