勞動者有辭職的自主權嗎?

我進入職(zhi)場不久(jiu),現在想咨詢一下(xia),請問勞動者有辭職(zhi)的(de)自主(zhu)權嗎(ma)?

《勞(lao)動(dong)合(he)同(tong)(tong)法(fa)》第37條(tiao)規定(ding):勞(lao)動(dong)者(zhe)提前(qian)30日以(yi)書面(mian)形(xing)式通知用人(ren)單(dan)位(wei),可以(yi)解(jie)(jie)除(chu)勞(lao)動(dong)合(he)同(tong)(tong)。這里(li),勞(lao)動(dong)者(zhe)是否(fou)需(xu)要(yao)合(he)適的理由沒有明確規定(ding)。也就是說,該(gai)條(tiao)規定(ding)實際上確認了勞(lao)動(dong)者(zhe)合(he)法(fa)的自主辭職權。勞(lao)動(dong)者(zhe)根據自身情況或者(zhe)個人(ren)發展(zhan)需(xu)要(yao),需(xu)要(yao)解(jie)(jie)除(chu)勞(lao)動(dong)合(he)同(tong)(tong)的,只要(yao)提前(qian)30日以(yi)書面(mian)形(xing)式通知用人(ren)單(dan)位(wei),即可以(yi)解(jie)(jie)除(chu)勞(lao)動(dong)合(he)同(tong)(tong)。當然(ran),如果勞(lao)動(dong)者(zhe)因個人(ren)原因解(jie)(jie)除(chu)勞(lao)動(dong)合(he)同(tong)(tong)違(wei)反了勞(lao)動(dong)合(he)同(tong)(tong)中(zhong)的相(xiang)關約定(ding)構(gou)成違(wei)約,則還應承擔相(xiang)應的違(wei)約責任。
