勞動者有辭職的自主權嗎?

答 《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同法(fa)》第37條規(gui)(gui)定:勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)提(ti)前(qian)30日以書面形(xing)式通知用(yong)人單(dan)位,可以解(jie)除勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同。這(zhe)里,勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)是否需(xu)(xu)要(yao)合適的(de)理由沒有明確規(gui)(gui)定。也(ye)就是說(shuo),該(gai)條規(gui)(gui)定實際上確認了勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)合法(fa)的(de)自主辭職權。勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)根據自身情(qing)況或者(zhe)(zhe)個(ge)人發展需(xu)(xu)要(yao),需(xu)(xu)要(yao)解(jie)除勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同的(de),只要(yao)提(ti)前(qian)30日以書面形(xing)式通知用(yong)人單(dan)位,即可以解(jie)除勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同。當(dang)然,如果勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)因個(ge)人原(yuan)因解(jie)除勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同違反了勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同中的(de)相關約(yue)定構成違約(yue),則(ze)還應承擔(dan)相應的(de)違約(yue)責任。
