答(da) 如果企(qi)業(ye)更換(huan)工(gong)作地(di)點,尤(you)其是這樣跨省市(shi)的(de)更換(huan),單位(wei)應該(gai)盡量(liang)向員(yuan)工(gong)提供上下班(ban)條(tiao)(tiao)件。如果實(shi)在(zai)有(you)困難,《中(zhong)(zhong)華人民共和國勞(lao)動(dong)(dong)(dong)(dong)(dong)法》第二十六條(tiao)(tiao)規定(ding):“有(you)下列情(qing)(qing)(qing)形之一的(de),用人單位(wei)可以解除勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)(tong),但(dan)是應當提前(qian)三十日(ri)以書面形式通知勞(lao)動(dong)(dong)(dong)(dong)(dong)者本人:……(三)勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)訂立時(shi)所依據的(de)客觀情(qing)(qing)(qing)況(kuang)發(fa)生(sheng)(sheng)(sheng)重大(da)變化,致(zhi)使(shi)原勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)無(wu)(wu)法履行(xing),經當事人協商不(bu)能(neng)就變更勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)達成協議(yi)的(de)。”對于該(gai)條(tiao)(tiao)中(zhong)(zhong)的(de)“客觀情(qing)(qing)(qing)況(kuang)發(fa)生(sheng)(sheng)(sheng)重大(da)變化”, 勞(lao)動(dong)(dong)(dong)(dong)(dong)部《關于〈中(zhong)(zhong)華人民共和國勞(lao)動(dong)(dong)(dong)(dong)(dong)法〉若干(gan)條(tiao)(tiao)文的(de)說明》中(zhong)(zhong)指(zhi)出:“本條(tiao)(tiao)中(zhong)(zhong)的(de)‘客觀情(qing)(qing)(qing)況(kuang)’指(zhi):發(fa)生(sheng)(sheng)(sheng)不(bu)可抗力或出現致(zhi)使(shi)勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)全(quan)部或部分條(tiao)(tiao)款無(wu)(wu)法履行(xing)的(de)其他情(qing)(qing)(qing)況(kuang),如企(qi)業(ye)遷移、被(bei)兼并(bing)、企(qi)業(ye)資產轉移等,并(bing)且排除本法第二十七條(tiao)(tiao)(經濟性裁員(yuan)——作者注)所列的(de)客觀情(qing)(qing)(qing)況(kuang)。”因此,這種情(qing)(qing)(qing)況(kuang)應該(gai)有(you)一個協商的(de)過(guo)程,實(shi)在(zai)無(wu)(wu)法通過(guo)協商解決(jue),公司應該(gai)解除勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)(tong),并(bing)支付經濟補償金(jin),不(bu)能(neng)逼迫(po)員(yuan)工(gong)自行(xing)辭(ci)職(zhi)。
