公司逼迫辭職怎么辦?

答 如(ru)(ru)果企(qi)業更換工作地(di)點,尤(you)其是這樣(yang)跨省市的(de)(de)更換,單(dan)位應(ying)該(gai)盡量(liang)向員(yuan)工提供上下班條(tiao)(tiao)件。如(ru)(ru)果實在(zai)有困難,《中(zhong)華(hua)人民共和(he)國(guo)勞(lao)(lao)(lao)動(dong)法》第(di)二(er)十(shi)六條(tiao)(tiao)規定:“有下列(lie)情(qing)(qing)(qing)(qing)(qing)形之(zhi)一(yi)的(de)(de),用人單(dan)位可(ke)以解除勞(lao)(lao)(lao)動(dong)合同(tong)(tong),但是應(ying)當提前三十(shi)日以書面(mian)形式通(tong)知(zhi)勞(lao)(lao)(lao)動(dong)者本人:……(三)勞(lao)(lao)(lao)動(dong)合同(tong)(tong)訂立時所(suo)(suo)依據的(de)(de)客(ke)觀(guan)情(qing)(qing)(qing)(qing)(qing)況發生(sheng)重(zhong)(zhong)大(da)變化,致(zhi)使(shi)原勞(lao)(lao)(lao)動(dong)合同(tong)(tong)無法履(lv)行(xing),經(jing)當事人協商不(bu)能(neng)就變更勞(lao)(lao)(lao)動(dong)合同(tong)(tong)達成協議的(de)(de)。”對于(yu)(yu)該(gai)條(tiao)(tiao)中(zhong)的(de)(de)“客(ke)觀(guan)情(qing)(qing)(qing)(qing)(qing)況發生(sheng)重(zhong)(zhong)大(da)變化”, 勞(lao)(lao)(lao)動(dong)部(bu)《關(guan)于(yu)(yu)〈中(zhong)華(hua)人民共和(he)國(guo)勞(lao)(lao)(lao)動(dong)法〉若干條(tiao)(tiao)文的(de)(de)說明》中(zhong)指出:“本條(tiao)(tiao)中(zhong)的(de)(de)‘客(ke)觀(guan)情(qing)(qing)(qing)(qing)(qing)況’指:發生(sheng)不(bu)可(ke)抗力(li)或(huo)出現致(zhi)使(shi)勞(lao)(lao)(lao)動(dong)合同(tong)(tong)全(quan)部(bu)或(huo)部(bu)分條(tiao)(tiao)款無法履(lv)行(xing)的(de)(de)其他情(qing)(qing)(qing)(qing)(qing)況,如(ru)(ru)企(qi)業遷(qian)移(yi)、被(bei)兼并、企(qi)業資產轉移(yi)等,并且排除本法第(di)二(er)十(shi)七條(tiao)(tiao)(經(jing)濟性裁員(yuan)——作者注)所(suo)(suo)列(lie)的(de)(de)客(ke)觀(guan)情(qing)(qing)(qing)(qing)(qing)況。”因此(ci),這種情(qing)(qing)(qing)(qing)(qing)況應(ying)該(gai)有一(yi)個協商的(de)(de)過程,實在(zai)無法通(tong)過協商解決,公司應(ying)該(gai)解除勞(lao)(lao)(lao)動(dong)合同(tong)(tong),并支付經(jing)濟補償金,不(bu)能(neng)逼迫員(yuan)工自行(xing)辭職(zhi)。
