公司規定不準辭職合法嗎?

問(wen) 最近(jin)跟公司簽(qian)訂(ding)了勞動合(he)同,想咨(zi)詢一下,公司規定(ding)不準辭職合(he)法(fa)嗎?

員工有(you)自己的辭職(zhi)權。《中(zhong)華人(ren)民共和國(guo)勞動(dong)(dong)(dong)法》第三十(shi)一(yi)條(tiao)規定:“勞動(dong)(dong)(dong)者解除(chu)勞動(dong)(dong)(dong)合同(tong),應當提前三十(shi)日以書(shu)面形(xing)式通知用(yong)人(ren)單(dan)(dan)位(wei)。”如果有(you)特殊情況,如在(zai)試(shi)用(yong)期(qi)內的,或者用(yong)人(ren)單(dan)(dan)位(wei)以暴力(li)、威脅(xie)或者非(fei)法限制人(ren)身自由的手段強(qiang)迫勞動(dong)(dong)(dong)的,勞動(dong)(dong)(dong)者還可以隨時通知用(yong)人(ren)單(dan)(dan)位(wei)解除(chu)勞動(dong)(dong)(dong)合同(tong)。在(zai)法律條(tiao)文中(zhong)員工都只是通知即可辭職(zhi),根本就不需要公司同(tong)意。
