答 根據《勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法》第(di)39條(tiao)規定,勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)有下(xia)列六(liu)種(zhong)情形之一的(de),用(yong)人(ren)(ren)單(dan)(dan)位(wei)可以(yi)解除勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong): (1)在試用(yong)期間被證明不符合(he)錄用(yong)條(tiao)件的(de)。 (2)嚴重(zhong)(zhong)違(wei)反用(yong)人(ren)(ren)單(dan)(dan)位(wei)的(de)規章制(zhi)度的(de)。 (3)嚴重(zhong)(zhong)失(shi)職,營私舞(wu)弊,給用(yong)人(ren)(ren)單(dan)(dan)位(wei)造成(cheng)重(zhong)(zhong)大損害(hai)的(de)。 (4)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)同(tong)時與其他用(yong)人(ren)(ren)單(dan)(dan)位(wei)建立勞(lao)動(dong)(dong)(dong)(dong)關系(xi),對完(wan)成(cheng)本單(dan)(dan)位(wei)的(de)工作(zuo)任務造成(cheng)嚴重(zhong)(zhong)影響,或者(zhe)(zhe)(zhe)經用(yong)人(ren)(ren)單(dan)(dan)位(wei)提出,拒(ju)不改正的(de)。 (5)以(yi)欺詐、脅(xie)迫的(de)手段或者(zhe)(zhe)(zhe)乘人(ren)(ren)之危,使(shi)對方在違(wei)背真實(shi)意思的(de)情況下(xia)訂立或者(zhe)(zhe)(zhe)變(bian)更勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong),致(zhi)使(shi)勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)無效的(de)。 (6)被依法追(zhui)究刑事責任的(de)。
