公司沒招到人就不能辭職么?

答 《勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)法(fa)(fa)》第(di)37條規定:“勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)提(ti)前(qian)30日(ri)(ri)(ri)以(yi)(yi)(yi)(yi)書面形式(shi)通知用(yong)(yong)人(ren)單位,可(ke)(ke)(ke)(ke)以(yi)(yi)(yi)(yi)解(jie)(jie)除勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)。勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)在試用(yong)(yong)期內提(ti)前(qian)3日(ri)(ri)(ri)通知用(yong)(yong)人(ren)單位,可(ke)(ke)(ke)(ke)以(yi)(yi)(yi)(yi)解(jie)(jie)除勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)。”由此可(ke)(ke)(ke)(ke)見,勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)可(ke)(ke)(ke)(ke)以(yi)(yi)(yi)(yi)根據自身(shen)情況或者(zhe)個人(ren)發展(zhan)需要(yao)(yao)等提(ti)出辭(ci)職,只要(yao)(yao)按法(fa)(fa)律規定的條件、程序,提(ti)前(qian)30日(ri)(ri)(ri)以(yi)(yi)(yi)(yi)書面形式(shi)通知用(yong)(yong)人(ren)單位,即可(ke)(ke)(ke)(ke)解(jie)(jie)除勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)。30日(ri)(ri)(ri)后(hou),勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)可(ke)(ke)(ke)(ke)以(yi)(yi)(yi)(yi)向用(yong)(yong)人(ren)單位提(ti)出辦理(li)解(jie)(jie)除勞(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)手(shou)續,用(yong)(yong)人(ren)單位應予(yu)以(yi)(yi)(yi)(yi)辦理(li),并(bing)依法(fa)(fa)支付相應的勞(lao)動(dong)(dong)(dong)(dong)(dong)報酬。顯然,該公司以(yi)(yi)(yi)(yi)找不(bu)到人(ren)代替工作崗(gang)位為(wei)由不(bu)準勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)辭(ci)職的做法(fa)(fa)是(shi)違法(fa)(fa)的。
