公司沒招到人就不能辭職么?

答 《勞(lao)動(dong)(dong)(dong)合同(tong)法(fa)》第37條規定:“勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)提前30日(ri)(ri)以(yi)書(shu)(shu)面形式(shi)通知(zhi)用(yong)人單(dan)位(wei)(wei),可(ke)以(yi)解除(chu)勞(lao)動(dong)(dong)(dong)合同(tong)。勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)在試用(yong)期內提前3日(ri)(ri)通知(zhi)用(yong)人單(dan)位(wei)(wei),可(ke)以(yi)解除(chu)勞(lao)動(dong)(dong)(dong)合同(tong)。”由此(ci)可(ke)見,勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)可(ke)以(yi)根據(ju)自身(shen)情況或(huo)者(zhe)(zhe)個人發展需要等提出(chu)辭職,只要按(an)法(fa)律(lv)規定的(de)條件、程序,提前30日(ri)(ri)以(yi)書(shu)(shu)面形式(shi)通知(zhi)用(yong)人單(dan)位(wei)(wei),即(ji)可(ke)解除(chu)勞(lao)動(dong)(dong)(dong)合同(tong)。30日(ri)(ri)后,勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)可(ke)以(yi)向用(yong)人單(dan)位(wei)(wei)提出(chu)辦(ban)理(li)解除(chu)勞(lao)動(dong)(dong)(dong)合同(tong)手續(xu),用(yong)人單(dan)位(wei)(wei)應予以(yi)辦(ban)理(li),并依法(fa)支付(fu)相(xiang)應的(de)勞(lao)動(dong)(dong)(dong)報酬(chou)。顯然,該(gai)公司(si)以(yi)找不(bu)到人代替工作崗位(wei)(wei)為由不(bu)準(zhun)勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)辭職的(de)做法(fa)是違法(fa)的(de)。
