答(da) 《勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同法(fa)(fa)(fa)》第37條規定:“勞(lao)(lao)動(dong)(dong)(dong)者提(ti)(ti)前(qian)30日(ri)以(yi)書面(mian)形(xing)式(shi)通(tong)(tong)知(zhi)用(yong)(yong)人(ren)(ren)(ren)單(dan)(dan)位,可(ke)以(yi)解除勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同。勞(lao)(lao)動(dong)(dong)(dong)者在試(shi)用(yong)(yong)期內提(ti)(ti)前(qian)3日(ri)通(tong)(tong)知(zhi)用(yong)(yong)人(ren)(ren)(ren)單(dan)(dan)位,可(ke)以(yi)解除勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同。”由此(ci)可(ke)見,勞(lao)(lao)動(dong)(dong)(dong)者可(ke)以(yi)根據(ju)自身情況(kuang)或者個人(ren)(ren)(ren)發展需(xu)要等(deng)提(ti)(ti)出辭職,只要按法(fa)(fa)(fa)律規定的條件、程(cheng)序,提(ti)(ti)前(qian)30日(ri)以(yi)書面(mian)形(xing)式(shi)通(tong)(tong)知(zhi)用(yong)(yong)人(ren)(ren)(ren)單(dan)(dan)位,即可(ke)解除勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同。30日(ri)后,勞(lao)(lao)動(dong)(dong)(dong)者可(ke)以(yi)向用(yong)(yong)人(ren)(ren)(ren)單(dan)(dan)位提(ti)(ti)出辦理解除勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同手續,用(yong)(yong)人(ren)(ren)(ren)單(dan)(dan)位應予以(yi)辦理,并依法(fa)(fa)(fa)支付(fu)相(xiang)應的勞(lao)(lao)動(dong)(dong)(dong)報酬(chou)。顯(xian)然(ran),該公司(si)以(yi)找不(bu)到人(ren)(ren)(ren)代替工(gong)作崗位為由不(bu)準(zhun)勞(lao)(lao)動(dong)(dong)(dong)者辭職的做(zuo)法(fa)(fa)(fa)是(shi)違法(fa)(fa)(fa)的。
