答 根據《勞(lao)動(dong)合(he)同法(fa)(fa)》第(di)19條的(de)(de)(de)(de)規定(ding):“試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)包含在(zai)勞(lao)動(dong)合(he)同期(qi)(qi)(qi)限(xian)內(nei)。”其實,用(yong)(yong)人單(dan)(dan)位(wei)在(zai)事實上雇用(yong)(yong)員工(gong)時就(jiu)(jiu)產生勞(lao)動(dong)關(guan)系,就(jiu)(jiu)應當與試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)內(nei)的(de)(de)(de)(de)勞(lao)動(dong)者訂立書面勞(lao)動(dong)合(he)同,并(bing)按(an)照(zhao)勞(lao)動(dong)合(he)同法(fa)(fa)的(de)(de)(de)(de)規定(ding)約(yue)(yue)定(ding)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)的(de)(de)(de)(de)期(qi)(qi)(qi)限(xian)。 如果用(yong)(yong)人單(dan)(dan)位(wei)違(wei)(wei)法(fa)(fa)約(yue)(yue)定(ding)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)期(qi)(qi)(qi)限(xian)規定(ding)的(de)(de)(de)(de),那么應當按(an)照(zhao)勞(lao)動(dong)合(he)同法(fa)(fa)第(di)83條的(de)(de)(de)(de)規定(ding)承擔法(fa)(fa)律責任:即用(yong)(yong)人單(dan)(dan)位(wei)違(wei)(wei)法(fa)(fa)約(yue)(yue)定(ding)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)的(de)(de)(de)(de),由(you)(you)勞(lao)動(dong)行(xing)(xing)政部門責令改(gai)正;違(wei)(wei)法(fa)(fa)約(yue)(yue)定(ding)的(de)(de)(de)(de)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)已經履行(xing)(xing)的(de)(de)(de)(de),由(you)(you)用(yong)(yong)人單(dan)(dan)位(wei)以勞(lao)動(dong)者試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)滿月工(gong)資(zi)為標準,按(an)已經履行(xing)(xing)的(de)(de)(de)(de)超(chao)過法(fa)(fa)定(ding)期(qi)(qi)(qi)限(xian)的(de)(de)(de)(de)期(qi)(qi)(qi)間向(xiang)勞(lao)動(dong)者支付賠償金。如果沒有(you)訂立書面勞(lao)動(dong)合(he)同,也(ye)要依(yi)據勞(lao)動(dong)合(he)同法(fa)(fa)和實施條例(li)的(de)(de)(de)(de)規定(ding)來辦理。
