在試用期未簽合同的怎么辦啊?

我現在在公司屬于試用期(qi)員工,想咨詢一下,在試用期(qi)未簽合(he)同的怎么辦啊?

根據(ju)《勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)法》第19條的規(gui)定(ding):“試(shi)用(yong)(yong)期(qi)(qi)包含在勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)期(qi)(qi)限內。”其(qi)實,用(yong)(yong)人單(dan)位(wei)(wei)在事實上雇用(yong)(yong)員(yuan)工(gong)時就(jiu)產生勞(lao)動(dong)(dong)(dong)關系(xi),就(jiu)應(ying)當與試(shi)用(yong)(yong)期(qi)(qi)內的勞(lao)動(dong)(dong)(dong)者訂立書(shu)面(mian)(mian)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong),并(bing)按照(zhao)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)法的規(gui)定(ding)約定(ding)試(shi)用(yong)(yong)期(qi)(qi)的期(qi)(qi)限。   如(ru)果用(yong)(yong)人單(dan)位(wei)(wei)違法約定(ding)試(shi)用(yong)(yong)期(qi)(qi)期(qi)(qi)限規(gui)定(ding)的,那(nei)么(me)應(ying)當按照(zhao)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)法第83條的規(gui)定(ding)承擔(dan)法律責任:即用(yong)(yong)人單(dan)位(wei)(wei)違法約定(ding)試(shi)用(yong)(yong)期(qi)(qi)的,由勞(lao)動(dong)(dong)(dong)行(xing)政部門責令改正(zheng);違法約定(ding)的試(shi)用(yong)(yong)期(qi)(qi)已(yi)(yi)經履(lv)行(xing)的,由用(yong)(yong)人單(dan)位(wei)(wei)以勞(lao)動(dong)(dong)(dong)者試(shi)用(yong)(yong)期(qi)(qi)滿月工(gong)資為(wei)標準,按已(yi)(yi)經履(lv)行(xing)的超過法定(ding)期(qi)(qi)限的期(qi)(qi)間向勞(lao)動(dong)(dong)(dong)者支付賠償(chang)金。如(ru)果沒有訂立書(shu)面(mian)(mian)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong),也(ye)要依據(ju)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)法和(he)實施條例(li)的規(gui)定(ding)來辦理。
