在試用期未簽合同的怎么辦啊?

我現在(zai)在(zai)公(gong)司屬于試用(yong)期(qi)員工(gong),想咨詢一下,在(zai)試用(yong)期(qi)未簽合同(tong)的怎么辦(ban)啊?

根據(ju)《勞動(dong)(dong)合(he)同(tong)法(fa)(fa)》第(di)19條(tiao)的(de)規(gui)(gui)定(ding):“試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)(qi)(qi)(qi)包含在(zai)勞動(dong)(dong)合(he)同(tong)期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)(xian)內。”其實,用(yong)(yong)人(ren)(ren)單位在(zai)事實上雇用(yong)(yong)員工(gong)時就(jiu)產(chan)生勞動(dong)(dong)關系,就(jiu)應當與試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)(qi)(qi)(qi)內的(de)勞動(dong)(dong)者(zhe)訂(ding)(ding)立(li)書面(mian)勞動(dong)(dong)合(he)同(tong),并按照(zhao)(zhao)勞動(dong)(dong)合(he)同(tong)法(fa)(fa)的(de)規(gui)(gui)定(ding)約(yue)定(ding)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)(qi)(qi)(qi)的(de)期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)(xian)。   如果用(yong)(yong)人(ren)(ren)單位違(wei)法(fa)(fa)約(yue)定(ding)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)(qi)(qi)(qi)期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)(xian)規(gui)(gui)定(ding)的(de),那么應當按照(zhao)(zhao)勞動(dong)(dong)合(he)同(tong)法(fa)(fa)第(di)83條(tiao)的(de)規(gui)(gui)定(ding)承擔法(fa)(fa)律責任(ren):即用(yong)(yong)人(ren)(ren)單位違(wei)法(fa)(fa)約(yue)定(ding)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)(qi)(qi)(qi)的(de),由(you)勞動(dong)(dong)行(xing)(xing)政部門(men)責令改正;違(wei)法(fa)(fa)約(yue)定(ding)的(de)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)(qi)(qi)(qi)已經(jing)履行(xing)(xing)的(de),由(you)用(yong)(yong)人(ren)(ren)單位以勞動(dong)(dong)者(zhe)試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)(qi)(qi)(qi)滿月工(gong)資為標準,按已經(jing)履行(xing)(xing)的(de)超過(guo)法(fa)(fa)定(ding)期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)(xian)的(de)期(qi)(qi)(qi)(qi)(qi)(qi)間向勞動(dong)(dong)者(zhe)支(zhi)付賠償金。如果沒有訂(ding)(ding)立(li)書面(mian)勞動(dong)(dong)合(he)同(tong),也要依據(ju)勞動(dong)(dong)合(he)同(tong)法(fa)(fa)和實施條(tiao)例的(de)規(gui)(gui)定(ding)來辦理(li)。
