想(xiang)咨詢一下大家,用人(ren)單位提前三十日以書(shu)面形式通知勞動者可以解(jie)除合(he)同么(me)?

有下列情形之一(yi)(yi)的,用(yong)(yong)人單(dan)位提前三十日以書面形式通知勞(lao)動(dong)(dong)(dong)者(zhe)本人或(huo)者(zhe)額外支付勞(lao)動(dong)(dong)(dong)者(zhe)一(yi)(yi)個月(yue)工(gong)資后,可以解除(chu)勞(lao)動(dong)(dong)(dong)合同: 1.勞(lao)動(dong)(dong)(dong)者(zhe)患病或(huo)者(zhe)非因工(gong)負(fu)傷,在(zai)規定的醫(yi)療(liao)期滿后不能(neng)從事原工(gong)作,也不能(neng)從事由用(yong)(yong)人單(dan)位另行安(an)排的工(gong)作的; 2.勞(lao)動(dong)(dong)(dong)者(zhe)不能(neng)勝任(ren)工(gong)作,經過(guo)培(pei)訓或(huo)者(zhe)調整工(gong)作崗位,仍(reng)不能(neng)勝任(ren)工(gong)作的; 3.勞(lao)動(dong)(dong)(dong)合同訂(ding)立時所依據的客觀情況發生重大(da)變化,致使(shi)勞(lao)動(dong)(dong)(dong)合同無(wu)法(fa)履(lv)行,經用(yong)(yong)人單(dan)位與勞(lao)動(dong)(dong)(dong)者(zhe)協(xie)商,未能(neng)就變更(geng)勞(lao)動(dong)(dong)(dong)合同內容(rong)達成協(xie)議(yi)的。
