答(da) 有下列情(qing)形之一(yi)的(de),用人單位提前三十日以書(shu)面形式通(tong)知勞(lao)(lao)(lao)動(dong)(dong)者(zhe)本人或(huo)者(zhe)額外支(zhi)付勞(lao)(lao)(lao)動(dong)(dong)者(zhe)一(yi)個月工(gong)(gong)資(zi)后,可以解除勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong): 1.勞(lao)(lao)(lao)動(dong)(dong)者(zhe)患病或(huo)者(zhe)非因工(gong)(gong)負傷(shang),在規定的(de)醫療期滿后不(bu)(bu)能從事原工(gong)(gong)作,也不(bu)(bu)能從事由用人單位另行安排的(de)工(gong)(gong)作的(de); 2.勞(lao)(lao)(lao)動(dong)(dong)者(zhe)不(bu)(bu)能勝任工(gong)(gong)作,經過培訓(xun)或(huo)者(zhe)調(diao)整工(gong)(gong)作崗位,仍(reng)不(bu)(bu)能勝任工(gong)(gong)作的(de); 3.勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)訂立時所依據的(de)客(ke)觀情(qing)況(kuang)發(fa)生重大變化(hua),致使勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)無法(fa)履行,經用人單位與(yu)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)協商,未能就變更勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)內(nei)容達(da)成(cheng)協議的(de)。
