勞動者違反勞動合同法需要承擔哪些責任?
問(wen) 在(zai)正式(shi)到工作崗位前,勞(lao)動(dong)者需(xu)與(yu)用(yong)人單位簽訂勞(lao)動(dong)合(he)同,但在(zai)某些(xie)情況下也會出現違約(yue)行為,那么勞(lao)動(dong)者違反(fan)勞(lao)動(dong)合(he)同法需(xu)要承(cheng)擔哪些(xie)責任?
答 首先勞(lao)動(dong)(dong)者必須承擔(dan)用(yong)人(ren)單(dan)位(wei)招收錄用(yong)其所支付(fu)的(de)(de)費用(yong),動(dong)(dong)者必須承擔(dan)用(yong)人(ren)單(dan)位(wei)為其支付(fu)的(de)(de)培訓費用(yong)。雙(shuang)方另有約(yue)定(ding)(ding)按約(yue)定(ding)(ding)辦理。其次對用(yong)人(ren)單(dan)位(wei)的(de)(de)生(sheng)產、經營和工作造(zao)成直接經濟損失(shi)的(de)(de),勞(lao)動(dong)(dong)者必須承擔(dan)賠償責(ze)任。最(zui)后勞(lao)動(dong)(dong)者違反(fan)勞(lao)動(dong)(dong)合同中約(yue)定(ding)(ding)的(de)(de)保密事(shi)項,給用(yong)人(ren)單(dan)位(wei)造(zao)成經濟損失(shi)的(de)(de),按《反(fan)不(bu)正(zheng)當競爭法》第20條的(de)(de)規(gui)定(ding)(ding)向用(yong)人(ren)單(dan)位(wei)支付(fu)賠償費用(yong),用(yong)人(ren)單(dan)位(wei)與(yu)勞(lao)動(dong)(dong)者在勞(lao)動(dong)(dong)合同中約(yue)定(ding)(ding)的(de)(de)其他賠償費用(yong)。
