答 《勞(lao)(lao)(lao)動(dong)(dong)合同法(fa)》第(di)十九條:試(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)包含在勞(lao)(lao)(lao)動(dong)(dong)合同期(qi)(qi)(qi)限(xian)(xian)內。勞(lao)(lao)(lao)動(dong)(dong)合同僅(jin)約定試(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)的,試(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)不(bu)(bu)成(cheng)立,該(gai)期(qi)(qi)(qi)限(xian)(xian)為勞(lao)(lao)(lao)動(dong)(dong)合同期(qi)(qi)(qi)限(xian)(xian)。所以根據以上(shang)規定,單位如果只單獨約定試(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)合同,該(gai)試(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)合同不(bu)(bu)成(cheng)立。
